Conditions for Car Driving Training Business from December 01, 2018

On October 08, 2018, the Government of Vietnam promulgated Decree No. 138/2018/ND-CP, amending and supplementing several articles of Decree No. 65/2016/ND-CP dated July 1, 2016, of the Government of Vietnam, stipulating conditions for the business of automobile driver training services and driver examination services.

Decree No. 138/2018/ND-CP includes amendments on conditions for business, granting, and revoking licenses for automobile driver training. To be specific:

Regarding conditions for driver technical classroom

Decree No. 138/2018/ND-CP fundamentally amends conditions for driver technical classrooms and clearly stipulates the technical infrastructure conditions such as: Driver technical classrooms must be equipped with teaching aids (tapes, projectors...); have pictures or drawings depicting basic driving maneuvers (adjusting the driver's seat, driving posture, steering wheel grip position...); have automobiles secured for cold and hot number training (can be arranged in a separate area); have a simulator device for driver training.

Regarding conditions for driving practice cars

Driver training institutions must have driving practice cars of various classes licensed by competent authorities; in cases where training institutions also provide driver examination services, based on the usage time of examination cars for testing purposes, they are allowed to use examination cars both for examinations and training, but the number of examination cars used for training must not exceed 50% of the examination cars used for teaching.

Training ground

The training ground must be legally used by the driver training institution.

Qualified teachers for theory and practice

Aside from the technical infrastructure, Decree No. 138/2018/ND-CP also amends conditions for teachers. Driver training institutions must have a team of qualified theory and practice teachers; ensuring at least one practice driving teacher per practice car.

The general standard for driving teachers must meet the standards for vocational education teachers at the primary level as prescribed by the law on vocational education.

Theory teachers must have a diploma from an intermediate level or higher in one of the fields of law, automotive technology, automotive engineering technology, car assembly, or other fields with automotive-specific training content making up 30% or more. Teachers of the subject "Driving Technique" must have a driving license corresponding to the training vehicle class or higher.

Practice teachers must meet the following standards:

– Have a driving license corresponding to or higher than the training vehicle class, but not lower than class B2;

– Teachers of class B1, B2 must have a driving license valid for 3 years or more from the date of issuance;

– Teachers of class C, D, E, and F must have a driving license valid for 5 years or more from the date of issuance;

– Have undergone training in driver practice teaching operations as per the program issued by competent authorities and certified as practice driving teachers according to the prescribed model.

Regarding authorized certification agencies for practice driving teachers

The Decree stipulates that the Directorate for Roads of Vietnam issues practice driving teacher certificates for teachers in central agencies assigned by the Ministry of Transport; the Department of Transport issues practice driving teacher certificates for teachers in locally managed training institutions...

Teachers who have been certified before the effective date of this Decree but do not meet the prescribed standards must comply with the regulations of this Decree before July 1, 2019.

Driver training licenses and driver examination center certificates issued before July 1, 2016, will be reissued after their validity period expires, once all conditions for the issuance of automobile driver training licenses or driver examination services are met.

The Decree is issued with forms for training requests, practice driving teacher certification.

This Decree takes effect starting December 01, 2018.
