Circular 09: Regulations on minutes and maps delineating protected areas of monuments

On July 14, 2011, the Ministry of Culture, Sports and Tourism issued Circular 09/2011/TT-BVHTTDL regarding the Regulation on the content of scientific dossiers for ranking historical - cultural relics and scenic spots.

In Article 12 of Circular 09/2011/TT-BVHTTDL, the minutes and boundary maps of protected areas of monuments are regulated as follows:

  1. The minutes marking the boundaries of the protected areas of monuments must record fully and accurately the information and have sufficient confirmation from the following agencies: People’s Committee at the commune level, Department of Culture and Information at the district level, Department of Natural Resources and Environment at the district level, People’s Committee at the district level, the unit preparing the scientific dossier of the monument (Monument Management Board or Provincial Museum), Department of Culture, Sports and Tourism, Department of Natural Resources and Environment, People’s Committee at the provincial level (for national and especially national classified monuments) following Form No. 3 issued with this Circular.

In cases where it is determined that the monument does not have protected area II, the Director of the Department of Culture, Sports and Tourism must provide a written explanation attached to the minutes marking the boundary of the protected area I of the monument.

  1. The preparation of the Boundary Map of the protected areas of monuments is regulated as follows:

- Extract cadastral maps in localities with monuments to represent the boundary delineation of the protected areas of the monuments;

- For those areas within the protected area that do not remain wholly within the existing parcels, necessary coordinates must be determined to clearly represent that portion of the area;

- For monuments where the protected area lies in regions without cadastral maps and those that are in vast, complex terrains, necessary coordinates must be determined to clearly represent the protected areas;

- The borderline surrounding the entire protected area I of the monument must be represented in red, and the borderline surrounding the entire protected area II of the monument must be represented in blue on the boundary map of the protected areas of the monument;

- The boundary map of the protected areas of the monument must have full confirmation from the agencies as stipulated in the minutes marking the boundary of the protected areas of the monuments.
