Recently, Decree 02/2014/ND-CP was enacted by the Government of Vietnam to regulate policies concerning the application and implementation of administrative handling measures for sending individuals to reformatory schools and compulsory education institutions.
According to Decree 02/2014/ND-CP, in case the person required to comply with the decision or their legal representative deems that the conditions for exemption from compliance with the decision for placement in a reformatory school are met, they shall prepare a dossier and send it to the Chief of the District Police where the People's Court has issued the decision to request the People's Court to consider and decide. The dossier includes:
- An application for exemption from the decision to place in a reformatory school stating the reasons;- An Official Dispatch requesting the People's Court to consider and decide on the exemption from the decision to place in a reformatory school;- One of the following documents:
- A document from a district-level or higher hospital certifying the serious illness of the person required to comply with the decision;- A document from a competent authority certifying that the person required to comply with the decision is no longer addicted to drugs;- A document from the Chairman of the People's Committee from the commune level or higher certifying significant progress in law compliance or a certificate of merit from the Chairman of the People's Committee from the district level or higher for meritorious deeds;- A document from a provincial-level or higher competent authority recognizing an initiative or technical improvement of value in labor;- A document from a hospital certifying pregnancy.
