04 Public Assets for Payment to Investors Implementing BT Projects?

Recently, Decree 69/2019/ND-CP was signed and issued by the Government of Vietnam. It regulates the use of public property to pay investors when implementing construction investment projects in the form of Build-Transfer Contracts.

According to current legal regulations, the Build-Transfer contract (hereinafter referred to as the BT contract) is an investment form signed between a competent state agency and an investor to construct infrastructure works; after completion, the investor transfers the project to the Government of Vietnam; the Government of Vietnam facilitates the investor to implement another project to recover investment capital and profits or makes payment to the investor as agreed in the BT contract.

According to the provisions of Decree 69/2019/ND-CP, public assets used to pay the investors executing BT projects include:

- Land fund.- Land, houses, and other assets attached to land of state agencies, public service providers, people's armed forces units, the Vietnam Communist Party agencies, political organizations - social organizations, political professional organizations, social organizations, professional social organizations, and other organizations established in accordance with the provisions of law on associations (hereinafter referred to as agencies, organizations, or units).- Infrastructure assets serving national and public interests.- Other types of public assets as stipulated by the Law on Management and Use of Public Assets.
