Recently, the Supreme People's Court of Vietnam issued Official Dispatch 82/TANDTC-TCCB to respond to voters' petitions for the operation of the Court, specifically related to regulations on the recruitment of court officials.

It is in accordance with regulations to require applicants for civil servants to have professional certificates in Vietnam (Artwork).

Specifically, the Supreme People's Court received a petition from the voters of Binh Dinh province transferred by the People's Volunteer Committee of the Standing Committee of the National Assembly according to Official Dispatch 427/BDN dated December 18, 2020, with the following content: "The Supreme People's Court The stipulates that candidates taking the civil service exam to enter the court industry must have a certificate of professional training in the profession of a court clerk or a court in specialized adjudication or adjudication is not appropriate. Because of the above conditions, fresh graduates will not be eligible to take the entrance exam for the court. Request the Supreme People's Court to consider abolishing the above provisions."

Regarding the content of this recommendation, the Supreme People's Court of Vietnam replied as follows:

At the sessions of the National Assembly, the issue of improving the quality of the contingent of cadres and civil servants of the Court sector always attracted the attention of the National Assembly deputies and delegations. The Supreme People's Court has proposed many solutions, from recruiting input, to training and fostering cadres; monthly online training; leadership selection exams... in order to improve the quality of the contingent of cadres and civil servants in the court sector to meet the requirements of the judicial reform that has been set at present.

According to Article 4 of Vietnam's Decree 138/2020/ND-CP on recruitment, employment, and management of civil servants, the conditions for the registration of civil servant recruitment are as follows:

The agency employing public servants shall determine other conditions as required by the candidate position but specified at Point g, Clause 1, Article 36 of the Law on Cadres and Civil Servants, consistent with the job position's competency framework but not less than common standards, must not be contrary to the provisions of the law, must not distinguish the type of training, and report in writing to the management agency to consider and decide.

Based on this regulation as well as the requirements on improving the quality of input and the needs of the People's Court, to meet the requirements of the candidate position, the Supreme People's Court of Vietnam has organized many recruitment periods, like:

- To consider and recruit students from foreign universities or graduates with excellent master's degrees for the Department of Examination Director of the Supreme People's Court;

- To organize entrance exams for excellent graduates for high-level people's courts (in order to promptly provide quality human resources to support the overloaded cassation and reopening work of the Supreme People's Court and the High People's Court);

- Or to organize an entrance exam for students who have graduated with a bachelor's degree in law or higher but have been trained in court and adjudication skills for local people's courts. (In order to supplement the force of clerks who do not need to be retrained, in order to promptly support the adjudication work, in the context of the COVID-19 epidemic, which has had a great impact on the work of the court sector, many localities have temporarily stopped receiving petitions and received citizens, many court sessions had to stop adjudicating.)

The recruitment periods have attracted many graduates from many universities, qualified to take the exam. As a result, quality human resources have been selected for the industry, contributing significantly to the work results of the People's Court sector in recent years, especially in the settlement and trial of various types of cases.

It can be said that the implementation of the above recruitment regulations is in accordance with the law, meeting the requirements of improving the quality of the contingent of civil servants of the Court sector.
