Who are labor mediators, and what benefits do they enjoy in Vietnam?

Besides the People's Court, labor mediators in Vietnam are also competent to settle labor disputes. So what benefits does the labor mediator enjoy?

1.  Who are labor mediators in Vietnam?

Labor mediators are the persons appointed by the chairpersons of provincial-level People's Committees to mediate labor disputes, disputes over vocational training contracts; support the development of labor relations.

2. Labor mediator standards in Vietnam

- Being a Vietnamese citizen, having full civil act capacity in accordance with the Civil Code, having good health and moral qualities.

- Having university level or higher and at least 03 years working in the field related to labor relations.

- Not being examined for penal liability or serving his/her sentence but not yet entitled to criminal record remission.

3. Regime of labor mediators in Vietnam

Labor mediators are entitled to the following regimes:

- Each actual day performing the duties of labor mediators appointed by competent agencies is entitled to a compensation rate of 5% of the monthly minimum salary calculated on the average of the regions for laborers working under labor contracts stipulated by the Government from time to time;

Provincial-level People's Committees may consider and submit to the People's Councils of the same level a decision to apply a higher level of retraining than that prescribed at this point in accordance with the capabilities of the local budget;

- Being able to arrange appropriate time for participating in the performance of tasks of labor mediators as prescribed by agencies, units and organizations in Vietnam ;

- Apply the prescribed per diem regime to cadres, civil servants and public employees during the period of performing the duties of labor mediators as prescribed;

- Participating in training, fostering and improving professional qualifications organized by competent authorities in Vietnam;

- Be rewarded according to the provisions of the Law on Emulation and Reward of Achievements in the performance of tasks of labor mediators according to regulations;

- Enjoy other regimes as prescribed by law.
