Is a person who commits the crime of destroying another person's property valued at less than 2,000,000 VND subject to imprisonment in Vietnam?

According to Article 178 of the Vietnam Criminal Code 2015 (as amended in 2017) regarding the crime of destruction or intentional damage to property:

(1) Anyone who destroys or intentionally damages another's property valued from 2,000,000 VND to less than 50,000,000 VND or less than 2,000,000 VND but falls under one of the following cases, shall be subject to a fine from 10,000,000 VND to 50,000,000 VND, community sentence up to 3 years or imprisonment from 6 months to 3 years:

- Has been administratively sanctioned for one of the acts specified in this Article but continues to violate;

- Has been convicted of this crime, has not yet had the conviction expunged, but continues to violate;

- Causes adverse effects on security, order, and social safety;

- The property is the main livelihood of the victim and their family;

- The property is an artifact or antique.

(2) In cases where the crime falls into one of the following circumstances, the offender shall be subject to imprisonment from 2 years to 7 years:

- Organized crime;

- Causes damage to property valued from 50,000,000 VND to less than 200,000,000 VND;

- The property is a national treasure;

- Uses substances dangerous for fire, explosion or other dangerous methods;

- To conceal another crime;

- For the official duties of the victim;

- Dangerous recidivism.

(3) If the crime causes damage to property valued from 200,000,000 VND to less than 500,000,000 VND, the offender shall be subject to imprisonment from 5 years to 10 years.

(4) If the crime causes damage to property valued at 500,000,000 VND or more, the offender shall be subject to imprisonment from 10 years to 20 years.

Additionally, the offender may also be fined from 10,000,000 VND to 100,000,000 VND, be prohibited from holding certain positions, practicing certain professions, or doing certain jobs from 1 year to 5 years.

Thus, the destruction of property valued under 2 million VND is generally not subject to imprisonment. However, the offender may still face imprisonment from 6 months to 3 years if they fall under one of the cases such as having been administratively sanctioned or convicted of property destruction before, causing adverse effects on security and order, the property being the main livelihood of the victim, or the property being an artifact or antique.
