Pursuant to Decree 24/2022/ND-CP issued by the Government amending the Decree on conditions for investment and operation in the field of vocational education.
The current form of the written request for division, separation and merger of a private college is Form No. 01, Appendix II issued together with Decree 24/2022/ND-CP.

When proposing to divide, separate and merge private colleges in Vietnam, how to prepare documents? How long will it take to receive the processing results?
Pursuant to the content specified at Point 3.3, Clause 3, Subsection I, Section B, Part II of the administrative procedures promulgated together with Decision 445/QD-LDTBXH in 2022, the agency, organization or individual requesting the division, separation or merger of a private college, the following documents should be prepared:
- 01 written request for division, separation or merger of the owning organization or individual or the Board of Directors;
- 01 scheme on division, separation and merger of vocational education institutions;
- 01 meeting minutes, resolutions of the Board of Directors or capital contributors to establish the college on the division, separation or merger of the college.
Accordingly, the above dossier is made into 01 set and sent to the competent agency for settlement.
Regarding the time limit for settlement, the basis specified in Clause 4, Article 10 of Decree 143/2016/ND-CP is supplemented by Point c, Clause 7, Article 1 of Decree 24/2022/ND-CP as follows:

4. Order and procedures for division, separation and merger of vocational education institutions
a) Agencies, organizations and individuals requesting the division, separation or merger of a vocational education institution shall send the dossier as prescribed in Clause 2 of this Article through the online public service portal or postal service or directly to the vocational training institution. agencies and organizations specified in Clauses b, c and d, Clause 1, Article 8 of this Decree;
b) Within 10 working days from the day on which the application is received, the agency or organization specified in Clauses b, c and d, Clause 1, Article 8 of this Decree shall appraise the application for division, separation or merger of the enterprise. Department of vocational education and training and submit it to the competent person specified in Clause 3 of this Article for decision on division, separation, merger or permission for division, separation or merger of the vocational education institution according to Form No. 03, Appendix II promulgated. attached to this Decree. In case the dossier is invalid or the decision on division, separation, merger or division is not permitted, a written reply shall be issued, clearly stating the reason.
Thus, according to the above-cited regulations, the time to process the application for division, separation and merger of a private college is 10 working days from the date of receipt of the application.
What are the conditions to be allowed to divide, separate and merge a private college in Vietnam?
Pursuant to Point 3.10, Clause 3, subsection I, Section B, Part II Administrative procedures promulgated together with Decision 445/QD-LDTBXH in 2022, the conditions for carrying out the procedures for division, separation and merger of private colleges are currently implemented, include:
- Conform to the master plan on the network of vocational education institutions approved by the competent authority.
- Ensure the interests of learners, teachers, lecturers, administrators, employees and employees.
- New colleges formed after the process of division, separation or merger must fully satisfy the following conditions:
+ Have a location for construction of physical facilities ensuring the minimum usable land area is 20,000 m2 for urban areas and 40,000 m2 for non-urban areas.
In case the site for construction of the college's facilities has both the land area used in the urban area and the land area used in the non-urban area, the land area shall be converted according to the ratio the correspondence between urban land and non-urban areas is 1:2;
+ Investment capital is legal capital, excluding the value of land, which is at least 100 (one hundred) billion VND.
