According to Clause 2, Article 41 of the Law on Military Service 2015:

2. Exemption from conscription for the following citizens:

a) A child of a martyr, a child of a first-class war invalid;

b) A brother or sister of a martyr;

c) A child of a second-class war invalid; a child of a military invalid with a work capacity decrease of 81% or more; a child of a person suffering from Agent Orange with a work capacity decrease of 81% or more;

d) A person engaged in cipher work who is not a soldier or a People's Public Security officer;

đ) Officials and public employees, youth volunteers assigned to work in areas with particularly difficult socio-economic conditions as stipulated by law for 24 months or more.

3. Citizens eligible for suspension of conscription as stipulated in Clause 1 of this Article, if no longer having the reason for suspension, shall be called for conscription.

Citizens eligible for suspension or exemption from conscription as stipulated in Clauses 1 and 2 of this Article, if volunteering, shall be considered for selection and calling for conscription.

4. The list of citizens eligible for suspension or exemption from conscription must be publicly posted at the headquarters of the commune-level People's Committee, offices, and organizations for a period of 20 days.

The 05 cases for exemption from conscription in Vietnam include:

(i) A child of a martyr, a child of a first-class war invalid;

(ii) A brother or sister of a martyr;

(iii) A child of a second-class war invalid; a child of a military invalid with a work capacity decrease of 81% or more; a child of a person suffering from Agent Orange with a work capacity decrease of 81% or more;

(iv) A person engaged in cipher work who is not a soldier or a People's Public Security officer;

Note:

What are the penalties for evading military service after being selected in Vietnam?

(1) Administrative fines:

According to Article 7 Decree 120/2013/ND-CP amended by Clause 9, Article 1 Decree 37/2022/ND-CP::

Violation of regulations on conscription

1. A fine of 30,000,000 VND to 40,000,000 VND for failing to be present at the scheduled time or place for assembly as stated in the conscription order without a legitimate reason.

2. A fine of 40,000,000 VND to 50,000,000 VND for fraudulent acts to evade the conscription order after being qualified for military service According to the health examination results for conscription stipulated by law.

3. A fine of 50,000,000 VND to 75,000,000 VND for failing to comply with the conscription order, except for the cases stipulated in Clauses 1 and 2 of this Article.

*4. Remedial measures: Compulsory fulfillment of military service for those who violate the regulations in Clauses 1, 2, and 3 of this Article.

Therefore, failing to comply with the conscription order (except for the acts stated in Clauses 1 and 2, Article 7 Decree 120/2013/ND-CP) will result in a fine of 50,000,000 VND to 75,000,000 VND.

In addition to the fine, the violator will also be compelled to fulfill military service.

(2) Criminal liability:

According to Article 332 of the Criminal Code 2015 regarding the crime of evading military service in Vietnam as follows:

Crime of evading military service

1. Anyone who fails to comply with the military service registration regulations, fails to comply with the conscription order, or fails to comply with the training assembly order, who has been administratively sanctioned for such acts or has been convicted of this crime, not yet having the criminal record expunged, and re-offends will be subject to non-custodial reform for up to 2 years or imprisonment from 3 months to 2 years.

2. Committing the crime under one of the following circumstances will be subject to imprisonment from 1 year to 5 years:

a) Self-inflicted injury or health damage;

b) Committing the crime during wartime;

c) Inciting others to commit the crime.

Additionally, According to Clause 8, Article 3 of the Law on Military Service 2015, evading military service is defined as failing to comply with the registration for military service; failing to comply with the health examination order for military service; failing to comply with the conscription order; failing to comply with the training, maneuver, and readiness for mobilization, and combat orders.

Evading the first conscription order will not result in criminal liability but only administrative penalties.

For the act of evading the conscription order if already administratively sanctioned or convicted of this crime and not yet having the criminal record expunged, the violator will be subject to non-custodial reform for up to 2 years or imprisonment from 3 months to 2 years.

Committing the crime under one of the following circumstances will be subject to imprisonment from 1 year to 5 years:

- Self-inflicted injury or health damage;

- Committing the crime during wartime;

- Inciting others to commit the crime.
