Pursuant to Article 6 of the Draft Law on Gender transformation of Vietnam, the specific case of a person who proposes to use sex hormones for gender transformation is as follows:
"Article 6. Conditions for applicants to use sex hormones for gender transformation
1. Have a complete biological sex.
2. Having a gender identity different from the existing biological sex.
3. Being full 16 years old or older, having full civil act capacity. For persons from full 16 years old to under 18 years old, the consent of their father, mother or legal guardian is required.
4. Being single.
5. Be mentally and physically healthy, with no contraindications to sex hormone therapy."
The case for people who recommend breast surgery or genital surgery for gender transformation
Pursuant to Article 7 of the Draft Law on Gender transformation of Vietnam, the case of a person requesting breast surgery or genital surgery for gender transformation is as follows:
"Article 7. Conditions for applicants for breast surgery or genital surgery for gender transformation
1. Satisfy the conditions specified in Clauses 1, 2, and 4, Article 6 of this Law.
2. Being full 18 years old or older, having full civil act capacity.
3. Has undergone sex hormone therapy continuously for 01 year, except for breast surgery from female to male.
4. Be mentally and physically healthy, with no contraindications to breast or genital surgery."

Pursuant to Article 10 of the Draft Law on Gender transformation of Vietnam, the conditions for hospitals to be allowed to receive sex hormone treatment for gender transformation are as follows:
"Article 10. Conditions for hospitals to be allowed to treat sex hormones for gender transformation
1. Being a hospital specializing in internal medicine, endocrinology, obstetrics or male studies; general hospital specializing in internal medicine, endocrinology, obstetrics or male studies; a pediatric hospital that has been granted a license to operate in accordance with the law on medical examination and treatment.
2. Having a doctor who has a certificate in medical examination and treatment related to hormone treatment and has been trained in hormone therapy for gender transformation."
What conditions must the hospital meet to be allowed to undergo gender transformation surgery?
In Article 11 of the Draft Law on Gender transformation of Vietnam, the conditions for hospitals to be allowed to undergo gender transformation surgery are specified as follows:
1. Hospitals are allowed to perform breast surgery for gender transformation when fully meeting the following conditions:
- Being a hospital specializing in cosmetology; a general hospital with a department of plastic surgery or plastic surgery that has been granted a license to operate in accordance with the law on medical examination and treatment.
- Having a doctor who has a certificate of medical examination and treatment in plastic surgery or plastic surgery and has been trained in breast surgery for gender transformation.
2. Hospitals are allowed to perform genital surgery for gender transformation when fully meeting the following conditions:
- Being a hospital with a department of plastic surgery, urology or endocrinology, obstetrics or gynecology that has been granted a license to operate in accordance with the law on medical examination and treatment.
- Having a doctor who has a certificate in medical examination and treatment in plastic surgery or plastic surgery and has been trained in specializing in genital surgery for gender transformation.
Dossiers and procedures for requesting the hospital to be allowed to perform medical interventions for gender transformation
Dossier to request the hospital to be allowed to perform medical interventions for gender transformation
Clause 1 Article 12 of the Draft Law on Gender transformation of Vietnam provides for the application file for permission for a hospital to be allowed to perform medical interventions for gender transformation, specifically as follows:
- An application for permission for sex hormone treatment or breast surgery or genital surgery for gender transformation;
- A copy of the hospital's Operation License;
- A declaration of personnel of the hospital authorized for sex hormone treatment or breast surgery or genital surgery for gender transformation.
Procedures for requesting the hospital to be allowed to perform medical interventions for gender transformation
Pursuant to Clause 2 Article 12 of the Draft Law on Gender transformation of Vietnam, the required procedures to request the hospital to be allowed to perform medical intervention for gender transformation include:
- The hospital that requests permission for sex hormone treatment or breast surgery or genital surgery to change sex shall send 01 (one) set of documents as prescribed in Clause 1 of this Article to the Ministry of Health or the Department of Health under the authority to issue the operating license.
- Within 15 days from the date of receipt of a complete dossier, the Ministry of Health or the Department of Health must organize an appraisal of the dossier and supplement the scope of professional activities in sex hormone treatment or breast surgery or genital surgery to transform gender for the hospital. In case of disapproval, must reply in writing and clearly state the reason.
- Within 05 working days after appraising the dossier, the Ministry of Health or the Department of Health must adjust the operation license for the medical examination and treatment establishment.
