What are the regulations on conferences, seminars, and meetings containing state secret contents of Vietnamese regulatory bodies and organizations?
According to the provisions of Article 17 of the Law on Protection of State Secrets 2018 on conferences, seminars, and meetings containing state secret contents of Vietnamese regulatory bodies and organizations as follows:
- The requirements for holding a conference, seminar, or meeting containing state secret contents of a Vietnamese regulatory body or organization are:
+ Use of the state secret is permitted in writing by one of the persons specified in Clause 1 and Clause 2 Article 15 of Law on Protection of State Secrets 2018;
+ Representative of the regulatory body or organization or a person assigned a task related to the state secret is attending;
+ The venue is secured, and the state secret must be protected from divulgence or loss;
+ Suitable equipment and devices are employed to protect the state secret;
+ There are plans to protect the conference, seminar or meeting;
+ The state secret container must be returned after the conference, seminar or meeting.
- The head of the regulatory body or organization deciding the holding of the conference, seminar or meeting containing state secret contents shall hold responsibility for fulfillment of the requirements prescribed in Clause 1, Article 17 of the Law on Protection of State Secrets 2018.
- Attendees of a conference, seminar or meeting containing state secret contents shall protect and use the state secret(s) according to regulations of this Law and the request of the host.
What are the requirements for conferences, seminars, and meetings involving foreign elements in Vietnam and containing state secret contents?
The provisions of Article 18 of the Law on Protection of State Secrets 2018 on conferences, seminars, and meetings involving foreign elements in Vietnam and containing state secrets contents as follows:
- Requirements for holding a conference, seminar or meeting involving foreign elements in Vietnam that contains state secret contents:
+ The conference, seminar, or meeting is held by a Vietnamese regulatory body or organization;
+ Use of state secret contents is permitted in writing by one of the persons specified in Clause 1 Article 16 of Law on Protection of State Secrets 2018;
+ The person specified in Point b, Clause 1, Article 17 of Law on Protection of State Secrets 2018 and representative of the foreign regulatory body/organization or individual participating in an international cooperation program or performing official duties concerning the state secret are required to attend;
+ The requirements specified in Points c, d, dd and e Clause 1, Article 17 of Law on Protection of State Secrets 2018 are satisfied.
- The head of the regulatory body or organization deciding the holding of the conference, seminar or meeting containing state secret contents shall hold responsibility for fulfillment of the requirements prescribed in Clause 1, Article 18 of Law on Protection of State Secrets 2018.
- Attendees of a conference, seminar or meeting containing state secret contents shall protect and use the state secret according to regulations of this Law and the request of the host; and not provide or transfer such state secret to a third party.
What are the regulations on holding conferences, seminars, and meetings containing state secret contents of Vietnamese regulatory bodies and organizations?
According to the provisions of Article 7 of Resolution 757/NQ-UBTVQH15 of 2023 on conferences, seminars, and meetings containing state secret contents of Vietnamese regulatory bodies and organizations as follows:
- The Chairman of the National Assembly shall decide on the use of state secret contents at conferences, seminars, or meetings without foreign elements presided over by the Standing Committee of the National Assembly.
- Heads of bodies and units specified in Clause 1, Article 3 of this Regulation shall decide on the use of state secret contents at conferences, seminars or meetings without foreign elements organized by the presiding body or unit.
- The Chairman of the National Assembly shall decide on the use of contents of state secrets classified as Secret and Confidentiality at conferences, seminars and meetings with foreign elements presided over by the Standing Committee of the National Assembly.
The competent persons specified at Point c, Clause 1, Article 6 of this Regulation shall issue decisions on the use of contents of state secrets classified as Secret and Confidentiality at conferences, seminars or meetings with foreign elements organized by the presiding body".
- Attendees in conferences, seminars or meetings containing state secret contents include representatives of bodies, organizations or persons assigned to perform duties related to state secrets.
For conferences, seminars or meetings involving foreign elements, attendees must be representatives of foreign bodies, organizations or individuals participating in international cooperation programs or performing official duties related to state secrets.
- The competence to decide on attendees in conferences, seminars or meetings containing state secrets is stipulated as follows:
+ The Chairman of the National Assembly shall decide on attendees in conferences, seminars and meetings chaired by the Standing Committee of the National Assembly at the request of the General Secretary of the National Assembly;
+ The General Secretary of the National Assembly, the Chairman of the National Council, the Chairman of the National Assembly Committee, the Head of the National Assembly Office, the Head of the Standing Committee of the National Assembly, the Director of the Institute for Legislative Studies shall decide on the attendees of conferences, seminars and meetings chaired by their bodies;
+ The heads of units shall decide the attendees of conferences, seminars and meetings chaired by their units".
- The body in charge of holding conferences, seminars or meetings shall decide on the circulation and withdrawal of state secret documents and containers serving conferences, seminars or meetings; when deciding to hold conferences, seminars or meetings, they shall notify in writing the Office of the National Assembly for coordinating in assurance.
The Office of the National Assembly shall coordinate in organizing and implementing the protection of state secrets in service of conferences, seminars and meetings.
The Office of the National Assembly shall guide the implementation of the provisions of this paragraph.
- Attendees of conferences, seminars or meetings containing state secrets shall protect and use state secrets in accordance with this Regulation and at the request of the chairperson organizing conferences, seminars or meetings.
For conferences, seminars, and meetings with foreign elements, attendees of conferences, seminars, and meetings are not provided or transferred state secrets to third parties.
- State secret documents must be stamped with the seal "Withdrawn Document" before being sent to attendees and must be withdrawn immediately after the conference, seminar or meeting ends.
In case attendees of conferences, seminars or meetings wish to retain state secret documents and containers for research or to serve assigned duties, they must send a written request to the body or organization in charge of holding the conference, seminar or meeting to request for retaining documents and commit to comply with regulations on the protection of state secrets for retained documents.
At the National Assembly session or a meeting of the Standing Committee of the National Assembly, delegates of the National Assembly wishing to retain state secret documents and containers for research or to serve assigned duties must send a written request to the General Secretary of the National Assembly to request for retaining documents and commit to comply with regulations on the protection of state secrets for retained documents.
