What is the application for registration of Vietnamese nationality of aircrafts?
Pursuant to the provisions of Clause 2, Article 5 of Decree No. 68/2015/ND-CP as amended and supplemented by Article 1 of Decree No. 64/2022/ND-CP. An application for registration of Vietnamese nationality of aircrafts includes:
- Application form according to the Form;
- Copies from master registers or certified true copies or photocopies of the originals or copies enclosed with their originals for appraisal purpose or electronic copies from master registers or certified true electronic copies of the originals of documents proving the legal status of the applicant if the applicant is a Vietnamese organization or individual.
If such documents are issued by a competent foreign authority, they shall be consularly legalized as prescribed by law, except for the cases in which consular legalization is exempted according to the international treaty to which the Socialist Republic of Vietnam is a signatory or principles of reciprocity.
- Copies enclosed with their originals for appraisal purpose or copies certified by the applicant that prepares the originals or electronic copies from master registers or certified true electronic copies of the originals of legal documents proving the ownership towards the aircraft;
- Copies enclosed with their originals for appraisal purpose or copies certified by the applicant that prepares the originals or electronic copies from master registers or certified true electronic copies of the originals of the Certificate of non-registration issued by manufacturer country or the Certificate of deregistration issued by the country in which the aircraft is granted registration;
- Copies enclosed with their originals for appraisal purpose or copies certified by the applicant that prepares the originals or electronic copies from master registers or certified true electronic copies of the originals of documents about technical conditions of the aircraft;
- Copies enclosed with their originals for appraisal purpose or copies certified by the applicant that prepares the originals or electronic copies from master registers or certified true electronic copies of the originals of the purchase contract of the aircraft or the lease contract or lease-purchase contract of the aircraft.
What are the procedures for registration of Vietnamese nationality of aircrafts?
Procedures for registration of Vietnamese nationality of aircrafts shall comply with the provisions of subsection 2, Section A, Part II of the administrative procedures issued together with Decision No. 1204/QD-BGTVT in 2022 with the following procedures:
Step 1: Submit administrative documents
The applicant for registration of Vietnamese nationality of aircrafts sends the dossier directly, via the postal system or in the electronic environment or in other forms to the Civil Aviation Authority of Vietnam and shall be responsible for the accuracy, truthfulness of the information stated in the dossier.
Step 2: Settlement of administrative procedures
- Within five (05) working days from the date of receipt of a complete dossier as prescribed, the Civil Aviation Administration of Vietnam shall issue the Certificate of registration of aircraft bearing Vietnamese nationality according to the Form;
In case of refusal, the Civil Aviation Authority of Vietnam must reply in writing to the requester, clearly stating the reason.
- In case the application is incomplete as prescribed, within two (02) working days from the date of receipt of the dossier, the Civil Aviation Administration of Vietnam shall issue a written instruction to the applicant to complete the application according to regulations.
