What is the schedule of receiving citizens of the Vietnam Ministry of Finance?
In Section I, the rules for receiving citizens at the headquarter of the Ministry of Finance issued together with Decision 1127/QD-BTC in 2022 as follows:
(1) Units at the headquarter of the Vietnam Ministry of Finance are responsible for receiving citizens making complaints and denunciations, petitions, and reflections on issues related to the state management functions of the Vietnam Ministry of Finance.
(2) Regular time for receiving citizens:
- The headquarter of the Vietnam Ministry of Finance receives citizens making complaints and denunciations, petitions, and reflections on the administrative working days of each week. The specific time is:
+ Morning: From 8:30 a.m. to 11:30 a.m.
+ Afternoon: From 13:30 to 16:30.
- Saturdays, Sundays and
(3) The place of receiving citizens
The place of receiving citizens at the headquarter of the Vietnam Ministry of Finance: Room 1.11, No. 28 Tran Hung Dao Street, Hoan Kiem District, Hanoi City.
(4) Responsibilities for receiving citizens:
- The Minister of Finance receives citizens periodically on the 15th of every month. If the date of receiving citizens by the Minister of Finance coincides with Saturday, Sunday, or public holidays, citizens will be received on the next working day.
- The Inspectorate of the Ministry of Finance is responsible for assisting the Minister of Finance in receiving citizens regularly at the headquarter of the Ministry of Finance in accordance with the provisions of the law.
- Heads of units at the headquarter of the Ministry of Finance are responsible for receiving citizens as authorized by the Minister of Finance or coordinating in receiving citizens at the request of the Inspectorate of the Ministry of Finance for issues related to the assigned management field.
- When the Minister of Finance or heads of units under the Ministry of Finance have made an appointment to receive citizens, but cannot receive citizens for objective reasons, the time for receiving citizens shall be postponed, and citizens must be notified in writing on the change of receiving citizens, the date and time of the next appointment.
In case the change is close to the scheduled reception of the citizen, it cannot be notified in writing, it can be notified directly to citizens.
What are the rights and obligations of citizens making complaints, denunciations, and petitions at the Vietnam Ministry of Finance?
According to the provisions of Section II, the Rules for receiving citizens at the headquarter of the Ministry of Finance issued together with Decision 1127/QD-BTC in 2022 as follows:
When coming to the Headquarter of the Ministry of Finance, citizens making complaints, denunciations and petitions, and reflections have the following rights and obligations:
(1) Citizens who come to make complaints, denunciations, petitions, and reflections have the following rights:
- Present complaints, denunciations, petitions, and reflections;
- Be guided and explained on contents related to their complaints, denunciations, petitions, and reflections;
- Make complaints and denunciations against law-breaking acts of the person receiving citizens;
- Receive notifications on the receipt and handling of complaints, denunciations, petitions, and reflections;
- In case the complainant, denouncer, petitioner or reflector is not fluent in Vietnamese, he/she has the right to use an interpreter;
- Other rights as prescribed by law on complaints and denunciations.
(2) Citizens who come to make complaints, denunciations, petitions, and reflections have the following obligations:
- Present identification papers, and power of attorney (if any) such as citizens' identity card or other identification papers issued by competent State agencies; do not carry weapons, incendiary substances, slogans or banners, and bulky objects into the headquarter of the Ministry of Finance.
- Have a proper and respectful attitude towards the person receiving the citizen; do not disturb security and order, misrepresent, slander, or insult the reputation and honor of the person receiving citizens.
- Citizens who come to the Citizen Reception Room must truthfully present the facts, clearly state their requests, and provide information and documents related to the contents of complaints, denunciations, petitions, and reflections; respect the guidance of the person receiving citizens.
- Citizens must not abuse their right to make complaints, denunciations, petitions, and reflections to misrepresent, slander, incite disorder at the Citizen Reception Room or commit acts of infringing, insulting, or obstructing the person receiving citizens from performing her/his duties.
- In case many citizens make the same complaint, denunciation, petition, or reflection on content, the person receiving citizens shall request these citizens to appoint a representative to present the contents of complaints, denunciations, petitions, and reflections to the person receiving citizens (hereinafter collectively referred to as representatives).
The representative must be the complainant, denouncer, petitioner, or reflector. The appointment of a representative must be expressed in writing signed or indicated by all complainants, denouncers, petitioners or reflectors.
In case there are from five to ten citizens, one or two representatives will be required; In case there are more than ten citizens, an additional representative may be appointed, but not exceeding five citizens. The representatives must take responsibility before the law for the legitimacy of the representation and the document appointing representatives.
- Do not arbitrarily film, photograph, or record without the consent of the person receiving citizens.
- Maintain hygiene and order, not to arbitrarily move or damage the property of the Citizen Reception Room.
- At the end of the reception time, all citizens must leave the headquarter of the Ministry of Finance and not stay in any way.
In what cases will the Vietnam Ministry of Finance refuse to receive citizens?
As for the regulations on cases of refusal to receive citizens, in Section IV of the Regulations on receiving citizens at the headquarter of the Ministry of Finance, issued together with Decision 1127/QD-BTC in 2022 as follows:
(1) The person receiving citizens at the headquarter of the Ministry of Finance may refuse to receive citizens coming to the place of receiving citizens, must explain to citizens the reasons for refusal to receive citizens, and at the same time, report to the person in charge of receiving citizens in the following cases:
- A citizen who is in a state of inability to control his/her behavior due to substance use, who suffers from a mental illness or another illness that results in the loss or limitation of his/her ability to control his/her behavior.
- A citizen who makes complaints or denunciations against cases that have properly settled policies and laws, have been examined, reviewed, and notified in writing by competent state agencies, and have been received, explained, and instructed but still deliberately make complaints or denunciations prolonged.
(2) The person in charge of receiving citizens must take a record of the violation and request the competent authority to handle citizens coming to the place for receiving citizens according to the provisions of the law in the following cases:
- Citizens who commit acts of threatening or insulting agencies, units, persons receiving citizens, duty executors, or committing other acts of violating the regulations of the place for receiving citizens.
- Other cases as prescribed by law.
