In which cases can the Death Certificate be reissued at the medical examination and treatment facility in Vietnam?

Pursuant to the provisions of Clause 2 Article 5 of Circular 24/2020/TT-BYT stipulating cases of re-issuance of Death Certificates as amended:

In case of errors when filling in death certificate:

Relatives of the deceased patients shall prepare application for reissuance of death certificate according to Annex III attached to this Circular together with documents proving errors in previously issued death certificates and submit to medical examination and treatment establishments in Vietnam that issued the original death certificates. Within 1 working day from the date on which adequate documents are received, medical examination and treatment establishments are responsible for recalling the erroneous death certificates for disposal; application and proving documents shall be kept with medical records stored at medical examination and treatment establishments. Reissued death certificates must specify number and book number of the original death certificates and mark the reissued death certificates as “Cấp lại” (Reissued). In case verification is required, verification must be conducted within 5 working days.

Documents proving errors: in case of errors in family name, middle name, first name, date of birth, nationality, passport number, ID number, Citizen Identity Card number or personal identification number of the deceased patients, attach copies of any of following documents: passport, ID card, Citizen Identity Card or other documents containing photos and personal information which proves the correct information issued by competent authorities and remains valid (family register, temporary residence registry, residence documents) and master registers of aforementioned documents for comparison.

In case of loss or damage of death certificates:

Relatives of the deceased patients shall prepare application for reissuance of death certificate according to Annex III attached to this Circular and submit to medical examination and treatment establishments that issued the original death certificates. Within 1 working day from the date on which application for reissuance of death certificates is received, medical examination and treatment establishments are responsible for recalling damaged death certificates, examining information in the application and comparing with the death certificates stored at medical examination and treatment establishments which have issued the death certificates. Reissued death certificates must specify number and serial number of the original death certificates and mark the reissued death certificates as “Cấp lại” (Reissued). In case verification is required, verification must be conducted within 5 working days.

In case of confusion about the surname, middle letter, name of the deceased, date of birth, nationality, passport number, identity card number, citizen identification card number, personal identification number of the deceased, a photocopy of one of the following documents proving the confusion shall be enclosed:

Passport, identity card, citizen identification card or other document with photo and personal information showing mistaken content issued by competent authorities, still valid for use (household registration book, temporary residence book, proof of residence)

Instructions for filling out an application for reissuance of a Death Certificate are as follows:

(1) Specify the name of the agency that reissued the Notice of Death.

(2) Specify the full name of the deceased person's next of kin (persons related to marriage, custody, persons of the same immediate blood and persons with surnames within three generations)

(3) Record according to the place of permanent registration; if there is no permanent place of registration, it shall be recorded according to the place of temporary registration; In case there is no permanent place of registration and temporary residence registration, it shall be recorded according to the place where you are living.

(4) Record information about identity documents such as passport, identity card or a valid replacement document (e.g. 001089123 ID card issued by Hanoi City Police on 20/10/2004).

(5) Record according to the Information of the Death Certificate issued for the first time that is mistaken or lost/torn/torn

(6) Suggest marking X in a box with confusion or loss/tearing/tearing.

To whom does the authority to reissue Death Certificates at medical examination and treatment establishments in Vietnam belong?

Pursuant to the provisions of Article 3 of Circular 24/2020/TT-BYT stipulates as follows:

Competence to sign the Diagnosis of Cause of Death Form and issue and re-issue the Death Certificate

Heads and persons in charge of professional and technical expertise at medical examination and treatment establishments specified in Article 2 of this Circular have the authority to sign the Diagnosis of Causes of Death and issue and re-issue Death Certificates. Heads and persons with professional and technical responsibilities may authorize in writing others to sign the Diagnosis of Cause of Death Form and issue and reissue the Death Certificate. The principal and authorized person must be responsible before law for the authorization and documents signed by them.

Thus, heads and persons responsible for technical expertise at medical examination and treatment establishments specified in Article 2 of Circular 24/2020/TT-BYT have the authority to re-sign and re-issue Death Certificates.
