Vietnam: What are the latest regulations on ensuring the supply of medical equipment for the prevention and control of Covid-19 in 2022?

Proactively produce, trade and ensure price stabilization of medical equipment to prevent and control the Covid-19 pandemic
According to the guidance in Section 1 of Official Dispatch 286/CD-BYT of Vietnam in 2022, the Ministry of Health proposes the People's Committees of the provinces and centrally-run cities to continue directing the initiative in production and business, and ensure the price stabilization of medical equipment for the prevention and control of Covid-19 as follows:
"In order to overcome the scarcity of medical equipment for COVID-19 prevention and control on the market and ensure product quality at reasonable prices, the requests the People's Committees of the provinces and centrally-run cities to strengthen and drastically direct the following contents:
1. Continue to direct production and import units of medical equipment for COVID-19 prevention and control in the locality to actively engage in production and business activities to meet the demand for medical equipment. COVID-19 prevention and control and ensuring price stabilization of medical equipment according to the contents of Official Dispatch No. 854/BYT-TB-CT dated February 23, 2022 of the Ministry of Health."
Specifically, previously in Official Dispatch 854/BYT-TB-CT of Vietnam dated February 23, 2022, there were detailed instructions on proactively conducting production and business activities to meet the needs of using medical equipment for the Covid-19 prevention and control, and ensure the stabilization of medical equipment prices as follows:
"In order to be ready and ensure the supply of medical equipment to serve the prevention and control of the COVID-19 pandemic, the Ministry of Health requested the People's Committees of the provinces and cities directly under the Central Government to coordinate in directing local units:
1. Medical equipment manufacturing and trading units:
- Actively increase production, sales and supply capacity of medical equipment for COVID-19 prevention and control, especially for SARS-CoV-2 Test Kit, Oxygen saturation meter in blood SpO2...
- Ensuring price stabilization of medical equipment for the prevention of COVID-19 pandemic, not selling to purchasing units, speculating to increase prices when domestic demand is high, causing market scarcity.
2. Market management and functional agencies:
- Strengthening the inspection and examination of the listing of the selling price and the correct selling of the listed price; examine acts of taking advantage of the scarcity of medical equipment in the market to speculate, hoard goods, buy goods or take advantage of the pandemic to increase the selling price of medical equipment to prevent COVID-19 -19 is unreasonable.
- Inspect and prevent units that purchase and speculate on medical equipment for COVID-19 prevention and control to profit, and resolutely handle violating organizations and individuals."

Strengthening the fight against smuggling, counterfeiting and checking the listed selling prices of medical equipment to prevent and control the Covid-19 pandemic
According to the guidance in Section 2 of Official Dispatch 286/CD-BYT of Vietnam in 2022, the Ministry of Health also proposed to strengthen the inspection and examination against smuggling, commercial fraud, counterfeit goods and strengthen the inspection, check work of the list of prices of medical equipment for Covid-19 prevention and control as follows:
"In order to overcome the scarcity of medical equipment for COVID-19 prevention and control on the market and ensure product quality at reasonable prices, the requests the People's Committees of the provinces and centrally-run cities to strengthen and drastically direct the following contents:
...
2. Strengthening the inspection and examination against smuggling, commercial fraud and counterfeiting according to the contents of Official Dispatch No. 729/BYT-TTrB dated February 18, 2022 of the Ministry of Health. At the same time, urgently direct functional agencies and market managers to strengthen the inspection and examination of the listing of selling prices and to sell at the correct listed prices, to check and prevent acts of taking advantage of the scarcity situation of medical equipment for speculation, hoarding, buying goods or taking advantage of the pandemic to increase the selling price of medical equipment for COVID-19 prevention and control; strictly handle violations."
Previously, in Official Dispatch 729/BYT-TTrB dated February 18, 2022 of the Ministry of Health of Vietnam, there were instructions on inspection and examination of anti-smuggling, commercial fraud and counterfeit goods for goods in the field Health care for the prevention and control of Covid-19 is as follows:
"In order to strengthen and improve the effectiveness and efficiency of the fight against smuggling, trade fraud and counterfeit goods for medical products under the management, the Ministry of Health proposes the People's Committees of The provinces, centrally-run cities, and units under the Ministry of Health shall direct and implement the following work contents:
1. Further strengthen the propaganda and dissemination of legal provisions on anti-smuggling, commercial fraud and counterfeit goods, raising awareness and sense of responsibility among officials, public servants and public employees and all people in participating in detecting and fighting violations of the law on prevention and combat of smuggling, commercial fraud and counterfeit goods.
2. Continue to review legal documents to amend, supplement or propose competent authorities to amend and supplement to avoid overlapping and creating legal loopholes in the fight against smuggling and trade fraud and counterfeit goods, especially those related to the medical field.
3. To step up the review of licensing activities for the production, import and trading of the following items: Preventive, disease, and curative drugs, cosmetics, food, chemicals, equipment and items serving pandemic prevention work such as protective clothing, gloves, medical masks, etc. to ensure both creating maximum favorable conditions for organizations, individuals and businesses to develop production and business, while ensuring do well the work of fighting and preventing acts of smuggling, commercial fraud and production and trading of counterfeit and poor quality goods.
4. Strengthen inspection and examination, especially in key areas prone to smuggling, trade fraud, counterfeit goods, and poor quality goods to promptly detect, correct and handle violations violation.
5. Enhance the exchange of information related to smuggling, commercial fraud and counterfeit and poor quality goods between the health sector and functional forces in the locality to improve the effectiveness and efficiency of the fight against smuggling, commercial fraud and counterfeiting.
6. Pursuant to the regulations of the National Steering Committee 389 on reporting work, request the Departments of Health of the provinces, cities and member units of the Steering Committee 389 of the Ministry of Health to fully and promptly implement the work. Also according to the guidance in Sections 3 and 4, Public Dispatch 286/CD-BYT of Vietnam in 2022, the Ministry of Health sets out the duties of the Department of Health, related units and medical facilities in ensuring the supply of medical equipment. "In order to overcome the scarcity of medical equipment for COVID-19 prevention and control on the market and ensure product quality at reasonable prices, the Ministry of Health proposed to the People's Committees of provinces and cities. Directly under the Central Government strengthens drastic direction on the following contents:

3. Direct the Department of Health and related units to post the winning price of the SARS-CoV-2 test kit locally; the list of circulation numbers and the license to import medical equipment has been revoked on the web portal of the province or city and the communication agencies of the province or city.
4. Direct the Department of Health to assign tasks to hospitals, health stations, pharmacies, and retailers to list prices of SARS-CoV-2 test kits and ensure the quality of the supply of this product to citizens."
