Vietnam: Guiding the pregnancy assessment process? How many days is the duration of a pregnancy test?
What is the order of reception and preparation in the pregnancy assessment process in Vietnam?
Pursuant to Subsection III Section 6 of Appendix 1 issued together with Circular 13/2022/TT-BYT, the order of receipt and preparation in the pregnancy assessment is prescribed as follows:
Step 1. Receiving referendum/request decisions, documents and objects of assessment
- The department assigned to receive and make the minutes of delivery of the referendum/request decision, the assessment dossier and the object of assessment.
* Dossiers submitted for assessment include:
- Decision on referendum/request for assessment.
- Legal copies of dossiers and documents related to the contents to be examined:
+ Medical records related to the assessment if the assessee has been examined and treated at a medical facility.
+ Decision on request/request for assessment, conclusion of previous assessment in case of additional assessment or re-assessment.
+ Minutes of testimony of victims, suspects, witnesses (if necessary).
+ Other documents related to the content to be examined.
* If eligible for an inspection, take the next steps of this process.
* Refusing to assess in case of ineligibility for assessment as prescribed in Clause 7, Article 1 of the Law amending and supplementing a number of articles of the Law on Judicial Assessment.
Step 2. Assignment of professional staff
- The leader of the unit assigns forensic assessors and assistants (NGV) to the forensic examiner to carry out the assessment.
- Duties of the Athlete:
+ Study records and documents.
+ Direct NGV to prepare tools and equipment for assessment.
+ Work with the staff of the solicitation agency/the person requesting the assessment.
+ Contact with the assessee.
+ Directing and guiding NGV the inspection sequence.
+ Examination; Sampling (if needed).
+ Assign specialized and subclinical examinations.
+ Request and prepare to hold professional consultations, consult experts (if necessary).
+ Complete the written record of the inspection process and the assessment conclusions.
+ Synthesize and evaluate clinical and subclinical results, specialized examinations, consultations,... make examiner conclusions.
+ Resolving arising in the process of assessment, reporting results to agency leaders.
+ During the assessment process, the athletes coordinate, discuss and agree before concluding the assessment.
- NGV's mission:
+ Prepare equipment, tools, supplies and means of protection.
+ Guide the assessee and measure height, weight, pulse measurement, temperature, blood pressure, chest circumference,...
+ Take photos during the inspection.
+ Clean tools, equipment and facilities.
+ Collection of results of specialized, subclinical, and diagnostic examinations,...
+ Assist supporters in drafting documents recording the process of carrying out the assessment and conclusion of the assessment, completing the assessment photos and submitting them to the fans for approval.
+ Complete the assessment dossier.
+ Perform other tasks as assigned by the athlete.
Step 3. Study records, documents
The athlete studies the dossier and documents before conducting the examination.
Step 4. Work with solicitor agency officials/assessment requesters
- Receiving the subject of assessment from the solicitor agency/person requesting the assessment.
- Ask the solicitor officer/requester:
+ Coordinate and supplement dossiers and documents if necessary.
+ Take the assessee to a specialist, do subclinical tests when indicated, take the results assigned to the assessment agency.
+ Ensure the safety of the assessee and the assessee.
+ Other tasks if necessary.
Step 5. Contact with the assessee
- Compare documents of the assessee (identity card/ citizen identity card, passport,...).
- Explain to the assessee the examination process before conducting the examination.
- Ask the assessee to coordinate in the assessment process.

What methods of pregnancy testing are used in pregnancy testing in Vietnam?
Pursuant to Subsection IV Section 6 of Appendix 1 issued together with Circular 13/2022/TT-BYT, there are regulations on methods in pregnancy assessment including:
(i) Examination
- General examination
+ Exploit the assessee's information about obstetric and gynecological history and other related information.
+ Assessment of mental condition: whether there is contact and cooperation with the athlete.
+ Assess the general condition of the body.
+ Measure height, weight, assess physical condition (fat, medium, thin,...).
+ Pulse measurement, blood pressure, body temperature, breathing rate.
+ Observe the assessment of skin, mucous membranes, auscultation, lungs.
+ Record abnormal signs (if any).
- Physical examination
Antenatal examination
+ Review and measure the size of the mammary glands, areola, nipples, examine the breast for strange discharge.
+ Look at the abdominal area, identify stretch marks and measure the abdomen.
+ Palpation of abdominal stiffness, measurement of uterine height.
+ Fetal auscultation.
Examination of the genital organs
- Assessment of secondary genital development.
- Evaluation of labia and labia development.
- Vulvar examination: Development and pathology.
- Hymen examination: Type of hymen, hymen tears, extent and location of tear, degree of hymen dilation.
Examination of other parts: Sequential examination from top down, front to back, from outside to inside: Head, face, neck, chest, abdomen, back, arms, legs.
(ii) Appointment of specialty and subclinical examination
- Depending on the case, the athlete appoints a specialist examination and the necessary subclinical:
+ Obstetric examination.
+ Ultrasound of pregnancy.
+ Tests to determine pregnancy.
+ Other necessary tests.
(iii) Consultation, expert consultation
Conduct consultations, and consult experts in case of need.
What is the duration of the pregnancy assessment procedure in Vietnam?
Pursuant to Article 2 of Circular 13/2022/TT-BYT, there are regulations on the time limit for conducting forensic assessment as follows:
Timeline of forensic examination
1. For cases where it is mandatory to request an assessment, it shall comply with the provisions of the Criminal Procedure Code.
2. For other cases, the following shall be done:
a) No more than 09 days for cases of assessment of sexual abuse, abuse, sex determination, pregnancy, male sexual ability and no more than 18 days for cases requiring consultation;
Thus, the time limit for assessment cases of pregnancy assessment is not more than 09 days and not more than 18 days for cases requiring consultation. Except for cases where it is mandatory to request an assessment in accordance with the provisions of the Criminal Procedure Code.
