Pursuant to Article 4 of Decree 80/2021/ND-CP stipulating as follows:
“Article 4. Principles of support”
1. Based on the ability to balance resources and prioritize support in each period, agencies and organizations supporting small and medium-sized enterprises shall decide on the number of enterprises eligible to receive guaranteed support. principles are as follows:
a) Small and medium-sized enterprises that apply first receive support first;
b) Women-owned small and medium-sized enterprises, small and medium-sized enterprises employing many women, and small and medium-sized enterprises that are social enterprises as prescribed by law are supported first.
2. In case a small and medium-sized enterprise simultaneously satisfies the conditions of different levels of support in the same support content as prescribed in this Decree and other relevant laws, the enterprise may choose the most profitable support level.
3. In addition to specific support contents according to the size of micro, small and medium enterprises detailed in this Decree, the general support contents for small and medium enterprises are applied to both small and medium enterprises. micro enterprises, small enterprises and medium-sized enterprises that satisfy the conditions for support specified in this Decree.
4. Small and medium-sized enterprises transformed from business households, innovative start-up small and medium-sized enterprises, and small and medium-sized enterprises participating in industry clusters and value chains are entitled to support contents as prescribed in Clause 2 of this Article. Chapter IV and other supporting contents do not overlap the provisions of Chapter III of this Decree.
5. Based on functions, tasks and implementation capacity, agencies and organizations supporting small and medium-sized enterprises directly provide support services or coordinate with other agencies, organizations and individuals. qualified personnel to provide support services to eligible small and medium businesses.”

Pursuant to Article 3 of Circular 06/2022/TT-BKHDT, there are guidelines on the implementation of support for small and medium-sized enterprises as follows:
“Article 3. Guidelines for supporting SMEs
1. SME-supporting agencies and organizations shall prioritize funding to support women-owned SMEs, SMEs that employ a lot of female workers, and SMEs that are social enterprises.
2. Agencies and organizations supporting SMEs shall base themselves on the provisions of Article 5 of Decree No. 80/2021/ND-CP to select criteria for determining the size of micro enterprises, small enterprises, and medium-sized enterprises. ensure that businesses enjoy the most favorable level of support.
3. SME-supporting agencies and organizations determine the size of SMEs, women-owned SMEs, and SMEs employing a lot of female workers based on the declaration as prescribed in Appendix 1 to Decree No. 80/2021/ND -CP. In case it is necessary to compare the information declared by the SME, the agency or organization supporting the SME shall base itself on the following documents:
a) Determining the size of SMEs:
- Balance sheet and income statement in financial statements.
- A list of employees currently employed by the SME together with the corresponding social insurance payment receipt. For employees whose social insurance premiums are paid by other units, the SME shall have a written certification that these employees have been paid social insurance premiums.
b) Determination of SMEs that use a lot of female employees: Enterprises that meet the requirements of Point a, Clause 3 of this Article and have a female labor rate that meets the requirements of Clause 8 Article 3 of Decree No. 80/2021/ND- CP.
c) Determining women-owned SMEs: Agencies and organizations supporting SMEs look up the percentage of contributed capital of female enterprise management and operation members at the National Business Registration Portal or at shareholder book if it is a joint stock company.
4. SMEs can propose multiple support contents in a support demand proposal. At the same time with the same support content, SMEs can only send to one agency or organization supporting SMEs.
5. SMEs are not limited to the number of times of support or the number of support contracts for the specified support contents, calculated in million VND/year/enterprise or million VND/year but must not exceed the rate. , the maximum support norm is specified in Decree No. 80/2021/ND-CP.
6. SME support agencies and organizations shall publicize SME support information as follows:
a) Register an account on the National SME Support Portal (hereinafter referred to as the Portal) at https://business.gov.vn and disclose information as prescribed at Point d Clause 5 Article 28 and Clause 6, Article 29 of Decree No. 80/2021/ND-CP.
b) Publicize on the website of their agency or unit the information specified at point a of this clause and detailed information about the focal point, the method of receiving and handling the request for assistance. support from SMEs; a list of products and services to support SMEs provided by their units; database on SME that has received support and related contents.
7. Documents and dossiers related to the proposed SME support content specified at Point b, Clause 4, Article 32 of Decree No. 80/2021/ND-CP submitted to the SME support agency or organization are copies or copy from the original, the original and does not need to be authenticated. In case of necessity, the agency or organization supporting SME requests the SME to provide the original or the original for information comparison.
8. The forms and forms in the appendix promulgated together with this Circular and the dossier of proposal for the support needs of SMEs, when submitted to the competent authority, can be in the form of a paper document (directly sent) or an electronic document. electronic documents (submitted online) and provide the original or the original for verification if requested. Electronic documents are archived in accordance with the law on archiving and can be presented when necessary.
9. SMEs are only allowed to support consulting contents specified in Decree No. 80/2021/ND-CP and this Circular when using consultants from the network of consultants.

Pursuant to Article 2 of Decree 80/2021/ND-CP stipulating as follows:
“Article 2. Subjects of application
1. Enterprises are established, organized and operate in accordance with the law on enterprises, and satisfy the criteria for identifying small and medium-sized enterprises as prescribed in Article 5 of this Decree.
2. Agencies, organizations and individuals involved in supporting small and medium enterprises.”
In Clause 2, Article 1 of Circular 06/2022/TT-BKHDT, there are guidelines on subjects to apply regulations on supporting small and medium-sized enterprises as follows:
“Article 1. Scope of regulation and subjects of application
…
2. Subjects of application:
a) The enterprise is established, organized and operates in accordance with the provisions of the law on enterprises and meets the provisions of Chapter II of Decree No. 80/2021/ND-CP on criteria for identifying SMEs.
b) Ministries, ministerial-level agencies, agencies attached to the Government, People's Committees of provinces and centrally run cities (hereinafter referred to as provincial-level People's Committees).
c) Agencies and organizations supporting SMEs.
d) Supplier of products and services to support SMEs. If the supplier is an organization, it must be established and operate in accordance with Vietnamese law.
dd) Agencies, organizations and individuals involved in supporting SMEs.”
Thus, the subjects to which the regulations on supporting small and medium-sized enterprises are applied will comply with the provisions mentioned above.
Circular 06/2022/TT-BKHDT will take effect from June 25, 2022.
