What to do when the Medical Assessment Council does not have a hematologist?

Pursuant to the provisions of Article 15 of Circular 01/2023/TT-BYT on appointment of assessors as follows:

Appointment of assessors
1. The assessor of the Central Medical Assessment Council in Vietnam shall be appointed by the decision of the Ministry of Health on the basis of the proposal of the standing agency of the Central Medical Assessment Council and the Medical Examination and Treatment Administration.
2. Assessors of the provincial Medical Assessment Council in Vietnam shall be appointed by a specialized agency under the Provincial-level People’s Committee at the request of the standing body of the Provincial Medical Assessment Council.
3. The assessors of the Medical Assessment Councils of the Ministries shall be appointed by the decisions of the Ministries on the basis of the proposal of the standing agency of the Medical Assessment Councils of the Ministries.
4. The number of assessors of the Medical Assessment Council shall be decided by the person competent to appoint, depending on the requirements and tasks of the Medical Assessment Council. Each specialty must have at least 02 (two) assessors. In case the Medical Assessment Council does not have doctors with specialties: Cardiology, Respiratory, Urology, Digestive, Musculoskeletal, Hematology - Blood Transfusion, Endocrinology, Immunology, it may appoint a General Internal Medicine specialist to replace. In this case, only each assessor shall be assigned to be responsible for examining and assessing at most 02 (two) specialties to ensure the quality of examination and assessment.

Thus, in case the Medical Assessment Council does not have a hematologist, it may appoint a general internal medicine doctor to replace.

In what cases is the medical assessor dismissed?

Pursuant to Article 16 of Circular 01/2023/TT-BYT on dismissal of assessors in Vietnam as follows:

Dismissal of assessors in Vietnam
1. The leader of the standing body of the Medical Assessment Council shall request the competent authority specified in Article 15 of this Circular to consider dismissal when the assessor falls into one of the following cases:
a) Violations against regulations on professional expertise, medical assessment, and professional ethics;
b) Insufficient professional capacity to perform medical assessment;
c) Not healthy enough to work;
d) There is a written request not to continue participating as an assessor and is approved by the direct management agency.
2. If a person appointed as an assessor, if he or she retires under the regime or changes jobs, he/she will automatically cease to be an assessor from the time of retirement or job transfer.

Thus, the leader of the standing body of the Medical Assessment Council shall request the competent authority specified in Article 15 of this Circular to consider dismissal when the assessor falls into one of the following cases:

- Violation of professional regulations, medical assessment, and professional ethics;

- Insufficient professional capacity to perform medical assessment;

- Not healthy enough to work;

- There is an application for not continuing to participate in the assessor and is approved by the direct management agency.

What are the powers and duties of a medical assessor?

According to the provisions of Article 17 of Circular 01/2023/TT-BYT on the duties and powers of assessors as follows:

Regarding the duties of the assessor:

- Carry out specialized examination and assessment according to the required contents written on the specialized examination sheet of the standing body of the Medical Assessment Council and send it to the assessor. After the examination is completed, the results shall be returned to the standing body of the Medical Assessment Council, and at the same time, the examination results shall be saved in the specialized examination book at the place where the assessor works;

- Participate in professional consultations at the request of the standing body of the Medical Assessment Council;

- Assessors operate on a part-time basis and take responsibility before law for the results of specialized examination and assessment performed by individuals;

- Attend the conclusion meeting of the Medical Assessment Council when invited to attend by the Council.

Regarding the powers of the assessor:

- To participate in continuous training courses, professional training courses on medical assessment;

- To enjoy benefits and regimes when participating in specialized examination and assessment activities, professional consultations, and Council meetings in accordance with the law and the standing agency of the Medical Assessment Council;

- Have the right to request not to work or stop working as an assessor;

- Having the right to refuse expertise when the subject or his/her legal representative intentionally does not cooperate.
