Vietnam: What are the regulations on the medical examination sequence? How are the medical examiner's minutes prescribed?
What is the task of assessing the standing body of the Provincial Medical Examiner's Council in Vietnam?
Pursuant to Article 11 of Circular 01/2023/TT-BYT stipulating as follows:
Duties of the standing body of the Provincial Medical Examiner's Council
1. Propose the establishment and consolidation of the Medical Assessment Council, appointment and dismissal of assessors of the Medical Assessment Council.
2. Receive, reviewe and settle dossiers of medical assessment in accordance with Decree No. 131/2021/ND-CP.
3. Carry out medical assessment in the order specified in Appendix 1 promulgated together with this Circular.
4. Assume the prime responsibility for, and coordinate with concerned units in, proposing professional medical assessment, organizational work, material foundations, equipment and human resources for medical assessment activities.
5. Settle or propose to settle proposals, petitions, complaints and denunciations related to medical assessment.
6. Manage the seal of the Medical Examiner's Council.
7. Keep medical assessment dossiers in accordance with law.
8. Annually summarize and report on the results of medical assessment activities to the direct management agency and the standing agency of the Central Medical Assessment Council.
Accordingly, the standing body of the Provincial Medical Examiner's Council shall perform the following tasks:
- Propose the establishment and consolidation of the Medical Examiner's Council, appointment and dismissal of assessors of the Medical Examiner's Council.
- Receive, review and settle dossiers of medical assessment requests.
- Carry out medical assessment in the order specified in Appendix 1 promulgated together with this Circular.
- Assume the prime responsibility for, and coordinate with relevant units in, proposing professional medical assessment, organization, facilities, equipment and human resources for medical assessment activities.
- Settle or proposing to settle proposals, petitions, complaints and denunciations related to the medical examination.
- Manage the seal of the Board of Medical Examiners.
- Keep medical examination records in accordance with the provisions of law.
- Annually summarize and report on the results of medical assessment activities to the direct management agency and the standing agency of the Central Medical Assessment Council.

How is the medical examination sequence regulated in Vietnam?
The standing agency of the Medical Assessment Council is the subject of the medical assessment sequence at all levels as prescribed in Section 2 Chapter 1 of Circular 01/2023/TT-BYT.
Specifically, the order of medical assessment is specified in Appendix 1 issued together with Circular 01/2023/TT-BYT as follows:
(1) Identify the subject of medical examination:
- First-time medical examination is the implementation of the first medical examination for the subject for the same purpose of assessment, regardless of the content of the assessment request.
- Medical evaluation is the implementation of a medical examination from the second time onwards for subjects who have been first medically examined for the same purpose of medical examination.
- Medical assessment is the implementation of medical assessment in the case specified in Clause 2 Article 6 of Circular 01/2023/TT-BYT.
- The final medical assessment is the implementation of medical assessment for the subjects specified in Article 7 of Circular 01/2023/TT-BYT.
(2) Check the comparison:
The person performing the medical assessment is responsible for checking and comparing the assessment object with one of the following documents:
- Identity card
- Or Citizen Identification
- Or Passport
- Or birth certificate for people under 14 years old
- Or a certificate from the Police of the commune, ward or town where the permanent residence is located
- Or temporarily post a portrait of the subject on a white background of 4 cm multiplied by (x) 6 cm, no more than 06 (six) months from the date of application and stamped with hybrid armor.
(3) General examination:
Doctors assigned by the standing agency of the Medical Assessment Council to process the dossier are responsible for making assessment and general examination dossiers and submitting them to the leaders of the standing agencies of the Medical Assessment Council for approval for appointment of specialty examinations (clinical examination, subclinical) in accordance with the assessment dossiers proposed by the organization or individual examiner.
(4) Specialist examination
The specialist examiner shall examine and conclude on the contents specified by the standing body of the Medical Examiner's Council. Where it is necessary to consult a specialist.
(5) Professional consultation
The head of the standing body of the Medical Examiner's Council is responsible for organizing and presiding over the consultation before the Medical Examiner's Council meets. In case of necessity, the Standing Body of the Medical Examiner's Council invites the subject, the assessor and other relevant members to attend.
(6) Meeting of the Medical Examiner's Council
Minutes of meetings of the Medical Examiner's Council shall comply with Appendix No. 3 issued together with Circular 01/2023/TT-BYT and be kept with medical examination records.
(7) Issuance of Medical Examiner's Minutes
The minutes of medical assessment shall be made by the standing agency of the Medical Assessment Council as prescribed in Clause 3, Article 18 of Circular 01/2023/TT-BYT and are kept together with the medical examination record.
(8) Record of medical examination
Medical examination and assessment dossiers shall be managed and stored according to the provisions of Circular 53/2017/TT-BYT dated December 29, 12 of the Minister of Health stipulating the time limit for preserving professional records and documents in the health sector.
