Responsibilities of the Head of Agencies, Organizations, and Units Managing the Subject of Payroll Streamlining
The responsibilities of the head of agencies, organizations, and units managing the subject of payroll streamlining are stipulated in Article 12 Decree 29/2023/ND-CP as follows:
Responsibilities of the head of agencies, organizations, and units directly managing the subject of payroll streamlining
1. Implement payroll streamlining as stipulated in this Decree.
2. Develop annual payroll streamlining plans according to the guidance of the higher-level managing agency.
3. Prepare a list of individuals subject to payroll streamlining and the budget estimations for allowances for each individual for submission to the competent authorities for approval.
4. After receiving approval from the competent authorities, handle the payroll streamlining and disburse allowances to each individual; pay social insurance and health insurance contributions for individuals receiving payroll streamlining policies as stipulated in point a, clause 2, Article 7 of this Decree.
5. If the payroll streamlining decision is not conformable, the head of the managing agency, organization, or unit must take the following responsibilities:
a) Notify the social insurance agency and related bodies to stop paying social insurance benefits and other policies to the individual subject to non-conformable payroll streamlining; transfer to the social insurance agency the funds already disbursed to the individual during the period they received social insurance benefits (pensions, social insurance allowances, funds for purchasing health insurance cards);
b) Take responsibility for recovering the funds for payroll streamlining policies already disbursed to the individual;
c) Pay the individual the difference between the salary and other policies as per the law compared to the social insurance benefits already received;
d) Consider and handle the responsibility of concerned individuals, and be accountable according to the law for any non-conformable issues in payroll streamlining.
Thus, according to the regulations, the head of the agencies, organizations, and units directly managing the payroll streamlining subjects has the following responsibilities:
- Implement payroll streamlining;
- Develop annual payroll streamlining plans;
- Prepare the list of persons subject to payroll streamlining and the budget estimations for allowances;
- Handle payroll streamlining and disburse policies to streamlining subjects;
- Take responsibility for resolving any non-conformable payroll streamlining cases.

How many groups of subjects are subject to payroll streamlining under the new regulations?
According to Article 2 Decree 29/2023/ND-CP, there are 03 groups subject to payroll streamlining as follows:
- Officials and public employees; commune-level officials and persons working under indefinite-term labor contracts with policies;
- Persons working under indefinite-term labor contracts with policies performing specialized professional duties listed under job positions of occupational titles specific to the sector and common professional service provider job positions;
- Non-specialized workers at the commune level who are redundant due to administrative restructuring and non-specialized workers in villages and residential groups.
Moreover, Decree 29/2023/ND-CP also supplements the voluntary payroll streamlining for individuals who are pregnant, on maternity leave, or raising a child under 36 months of age.
What are the principles for implementing payroll streamlining?
According to the provisions of Article 3 Decree 29/2023/ND-CP as follows:
Principles of payroll streamlining
1. Ensure the leadership of the Communist Party, promote the role of supervision by political and social organizations, and the people in the process of implementing payroll streamlining.
2. Link payroll streamlining with organizational restructuring towards a more streamlined, efficient, and effective operation, and restructure, elevate the quality of officials and public employees according to job positions, in line with the autonomy mechanism of agencies, organizations, and units.
3. Ensure the principles of democratic centralism, objectivity, fairness, openness, transparency, and follow the provisions of the law.
4. Ensure the prompt and full disbursement of payroll streamlining policies as stipulated by law, and ensure the efficient use of the state budget.
5. The head must be responsible for the results of implementing payroll streamlining within the agency, organization, or unit assigned to manage according to their authority.
6. If a payroll streamlined individual is re-elected or re-employed in agencies, organizations, and units that receive salaries from the state budget within 60 months from the day of payroll streamlining, they must return the received allowance to the agency, organization, or unit that disbursed the allowance.
Thus, the new payroll streamlining regulations are implemented based on the 06 principles mentioned above.
Decree 29/2023/ND-CP officially takes effect from July 20, 2023. The policies in Decree 29/2023/ND-CP will be applicable until December 31, 2030.
