What is the authority to evaluate officials in the People's Court?
Based on Article 5 of the Regulation issued with Decision 01/QD-TANDTC of 2019, the provisions are as follows:
Authority to evaluate and classify officials, public employees, and workers
1. The Chief Justice of the Supreme People's Court has the authority to evaluate and classify the Heads of units under the Supreme People's Court; Chief Justices of the High People's Courts; Chief Justices of the People's Courts of provinces and cities under the central government.
2. The Heads of units under the Supreme People's Court have the authority to evaluate and classify their deputies, officials, public employees, and workers within their units.
3. The Chief Justices of the High People's Courts have the authority to evaluate and classify the Deputy Chief Justices, officials, and workers of the High People's Courts under their management.
4. The Chief Justices of the People's Courts of provinces and cities under the central government have the authority to evaluate and classify the Deputy Chief Justices, officials, and workers of the People’s Courts of provinces and cities under the central government; Chief Justices of the district-level People's Courts under their management.
5. The Chief Justices of the district-level People’s Courts have the authority to evaluate and classify the Deputy Chief Justices, officials, and workers of the district-level People’s Courts under their management.
The authority to evaluate officials in the People's Court is as follows:
- The Chief Justice of the Supreme People's Court has the authority to evaluate and classify the Heads of units under the Supreme People's Court; Chief Justices of the High People's Courts; Chief Justices of the People's Courts of provinces and cities under the central government.
- The Heads of units under the Supreme People's Court have the authority to evaluate and classify their deputies, officials, public employees, and workers within their units.
- The Chief Justices of the High People's Courts have the authority to evaluate and classify the Deputy Chief Justices, officials, and workers of the High People's Courts under their management.
- The Chief Justices of the People's Courts of provinces and cities under the central government have the authority to evaluate and classify the Deputy Chief Justices, officials, and workers of the People's Courts of provinces and cities under the central government; Chief Justices of the district-level People’s Courts under their management.
- The Chief Justices of the district-level People’s Courts have the authority to evaluate and classify the Deputy Chief Justices, officials, and workers of the district-level People’s Courts under their management.

What is the procedure for evaluating officials for Heads of People’s Courts?
Based on point b, clause 1, Article 7 of the Regulation issued with Decision 01/QD-TANDTC of 2019, the provisions are as follows:
For the leaders of units under the Supreme People's Court; Chief Justices and Deputy Chief Justices of the High People's Courts; Chief Justices and Deputy Chief Justices of the People’s Courts of provinces and cities under the central government; Chief Justices and Deputy Chief Justices of the district-level People’s Courts:
Step 1: Officials and public employees prepare a self-assessment report of work results according to assigned tasks using the Evaluation Form in the Annex; gather written evaluation comments from the party committee where they work and the party committee where they reside.
Step 2: Heads of units under the Supreme People's Court; Chief Justices of the High People's Courts; Chief Justices of the People’s Courts of provinces and cities under the central government; Chief Justices of the district-level People’s Courts organize a key officials conference including representatives from the party committee, trade union, youth union, and heads of constituent units to gather feedback on the Evaluation Form of officials and public employees. The feedback is recorded in minutes and approved at the meeting.
Step 3: Heads of units under the Supreme People's Court; Chief Justices of the High People's Courts; Chief Justices of the People’s Courts of provinces and cities under the central government; Chief Justices of the district-level People’s Courts, based on the feedback from Step 1 and Step 2, prepare a proposal for evaluation and classification of their unit leaders and report to the Chief Justice of the Supreme People's Court (through the Department of Organization and Personnel); Chief Justices of the People’s Courts of provinces and cities under the central government (through the Department of Organization and Personnel, Inspection and Emulation-Commendation). Proposals for evaluation and classification of the Heads of units under the Supreme People's Court; Chief Justices of the High People's Courts, the People’s Courts of provinces and cities under the central government, Chief Justices of the district-level People’s Courts must be submitted by December 5 each year.
Step 4: The Department of Organization and Personnel consolidates the evaluation and classification proposals of the Heads of units under the Supreme People's Court; Chief Justices of the High People's Courts; Chief Justices of the People’s Courts of provinces and cities under the central government for reporting and seeking comments from the Deputy Chief Justice of the Supreme People's Court in charge by December 8 each year.
Step 5: The Chief Justice of the Supreme People's Court will evaluate and announce the evaluation and classification results for leaders, officials, and public employees by December 10 each year.
Heads of units under the Supreme People's Court; Chief Justices of the High People's Courts; Chief Justices of the People’s Courts of provinces and cities under the central government, Chief Justices of the district-level People’s Courts will decide and announce the evaluation and classification results for their deputies by December 10 each year.
When are the evaluation and classification of officials, public employees, and workers conducted?
Based on Article 8 of the Regulation issued with Decision 01/QD-TANDTC of 2019, the provisions are as follows:
Evaluation and classification of officials, public employees, and workers are conducted based on the work year as follows:
- The evaluation and classification of officials, public employees, and workers are carried out in December each year before the annual emulation and commendation review;
- When officials, public employees, and workers transfer to a new workplace, the new unit is responsible for evaluating and classifying them in coordination with the evaluation comments from the previous unit (for those who have worked in the previous unit for six months or more).
