Pursuant to the provisions of Clause 10, Article 60 of the Law on Medical Examination and Treatment 2023 on responsibilities of medical establishments:

10. Refer and transfer patients to other medical establishments capable of dealing with a patient's clinical condition and needs if:
a) the medical establishment concludes that the patient case goes beyond its professional competence or lies outside of its scope of operation.
b) such referral or transfer is demanded by the patient or his/her representative, and approved by the medical practitioner who directly treat the patient, or by the clinical shift worker;
c) the medical establishment referring or transferring the patient is subject to temporary suspension or termination of its operation, or revocation of its operating license;
d) the medical establishment referring or transferring the patient faces a force majeure situation to the extent of being unable to continue the receipt and treatment of the patient needing medical care.
11. Participate in preventive healthcare activities as prescribed by law.
12. Buy medical professional liability insurance in accordance with the Government's regulations.
Thus, patients shall be transferred to other medical establishments capable of dealing with a patient's clinical condition and needs if:
- the medical establishment concludes that the patient case goes beyond its professional competence or lies outside of its scope of operation.
- such referral or transfer is demanded by the patient or his/her representative, and approved by the medical practitioner who directly treat the patient, or by the clinical shift worker;
- the medical establishment referring or transferring the patient is subject to temporary suspension or termination of its operation, or revocation of its operating license;
- the medical establishment referring or transferring the patient faces a force majeure situation to the extent of being unable to continue the receipt and treatment of the patient needing medical care.
Therefore, if the patient or his/her representative demand a transfer, which is approved by the medical practitioner who directly treat the patient, or by the clinical shift worker, the medical establishment shall transfer the patient to another medical establishment.
A medical establishment shall transfer a patient to another medical establishment when there is a demand of the patient. However, if the medical practitioner who directly treat the patient, or the clinical shift worker does not approve, the medical establishment shall not transfer patients to other medical establishments.

Who has the power to sign the slip of transfer at a medical facility in Vietnam?
Pursuant to the provisions of Article 6 of Circular 14/2014/TT-BYT on the power to sign the slip of transfer:

1. Regarding public medical facilities: the Head of the medical facility or the person authorized by the Head of the medical facility is in charge of signing the slip of transfer.
2. Regarding public medical facilities: the person in charge of professional skills of the medical facility or the person authorized by him/her is in charge of signing the slip of transfer.
3. In a shift, the leader of the team is in charge of signing the slip of transfer.
Thus, the power to sign the slip of transfer is as follows:
- Regarding public medical facilities: the Head of the medical facility or the person authorized by the Head of the medical facility is in charge of signing the slip of transfer.
- Regarding public medical facilities: the person in charge of professional skills of the medical facility or the person authorized by him/her is in charge of signing the slip of transfer.
- In a shift, the leader of the team is in charge of signing the slip of transfer.
What are the regulations on the transport of patients for emergency cases and non-emergency cases during the transfer of patient in Vietnam?
Pursuant to Article 8 of Circular 14/2014/TT-BYT and Clause 7, Article 147 of Decree 96/2023/ND-CP on the transport of patients during the transfer of patient:

1. For emergency cases: the medical facility shall prepare for transport of the patient as follows:
a) Ambulances or other suitable vehicles;
b) Medical equipment, emergency medicines for the patient (if any) during the transport;
c) The medical officials going with the patient shall be doctors, physician assistants and/or midwives in charge of supervising the handling promptly the development of condition of the patient during the transport and transporting the patient with conformable techniques according to the condition of the patient.
2. For non-emergency cases:
Depending on the medical condition of the patient and the actual conditions, the medical facility shall guide the patient or his/her legal representative to choose a suitable form and vehicle of transport.
Thus, the regulations on the transport of patients for emergency cases and non-emergency cases during the transfer of patient are as follows:
- For emergency cases: the medical facility shall prepare for transport of the patient as follows:
