Is the PPP project in Vietnam E-HSMST approved through the National Procurement Network?
Pursuant to Article 22 of Circular 10/2022/TT-BKHDT stipulates as follows:
“Article 22. Preparation, submission, appraisal and approval of PPP project E-HSMST”
1. Preparation, submission, appraisal and approval of E-HSMST:
The bid solicitor organizes the preparation of the E-HSMST on the System. After making the E-SMST, the bid solicitor shall submit it to the competent authority for the competent authority to organize the appraisal and approval of the E-HSMST. E-HSMST approval is done offline
2. The E-HSMST must include all necessary information to serve as a basis for the investor to prepare the E-HSDST. In case the competent authority, the bid solicitor publishes the E-HSMST with incomplete information or the information is unclear compared to the approved EISMST, leading to difficulties for the investor in preparing the EHSDST, the having jurisdiction, the party [T HSMST accordingly and re-uploads the E-HSMST.

Thus, the preparation, submission, appraisal and approval of the E-HSMST of PPP project in Vietnam are carried out in accordance with the above regulations. Accordingly, the approval of the E-HSMST of the PPP project in Vietnam will not be done online.
How to prepare, submit, appraise and approve the E-HSMST of PPP project in Vietnam from August 1, 2022 on the national bidding network system?
How to open bids and appraise and approve PPP project in Vietnam prequalification results?
Pursuant to Article 23 of Circular 10/2022/TT-BKHDT providing for the opening of bids for PPP project in Vietnam, prequalification shall be applied as follows:
"Article 23. Bidding for PPP projects applying pre-qualification
The bid solicitor must open bids and publicize the bid opening minutes on the System within 2 hours from the time of bid closing.
Accordingly, the bid opening minutes must be opened by the bid solicitor and publicized on the national bidding network system within 02 hours from the time of bid closing.
Pursuant to Article 24 of Circular 10/2022/TT-BKHDT stipulating the submission, appraisal and approval of results of pre-qualification of PPP project in Vietnam as follows:
"Article 24. Submission, appraisal and approval of PPP project prequalification results
1. The bid solicitor shall submit the results of pre-qualification to the competent authority and at the same time send it to the appraisal unit.
2. The competent authority shall approve the results of pre-qualification on the basis of the E-HSDST evaluation report and report, and the report on evaluation of the pre-qualification results."
Thus, the submission, appraisal and approval of the results of pre-qualification of PPP project in Vietnam will be carried out in accordance with the above regulations.
From when is it mandatory to provide and post information for projects subject to bidding according to specialized laws on the National Procurement Network?
Pursuant to Article 25 of Circular 10/2022/TT-BKHDT stipulating the roadmap for applying online investor selection as follows:
"Article 25. Roadmap for application of online investor selection
Ministries, ministerial-level agencies, Governmental agencies, People's Committees of provinces and centrally run cities organize online investor selection according to the following schedule:
1. From June 1, 2023, the provision and posting of information for projects subject to bidding according to specialized laws and laws on socialization shall be carried out on the System.
2. From August 15, 2023, the issuance of E-KSQT, E-HSMST, E-YCSBNLKN and submission of E-HSQT, E-HSDST, E-HSDKTHDA for PPP projects, investment projects that use land is made on the System."
Thus, the provision and posting of information for projects subject to bidding according to specialized laws and laws on socialization must be made compulsory on the National Procurement Network from June 1, 2023. .
On what principle is investor selection through the National Procurement Network made?
Pursuant to Article 5 of Circular 10/2022/TT-BKHDT stipulates as follows:
"Article 5. Principles of application of online investor selection
1. Electronic documents transacted through the System, information posted on the System are considered original documents, have legal validity and have the same effect as paper documents, serving as a basis for public service. assessment, appraisal, inspection, examination, audit and disbursement.
2. The bid solicitor shall open bids on the System immediately after the bid closing time. If there is no investor to submit the application, the survey of interest in PPP projects, invitation for interest in investment projects using land, and online prequalification of PPP projects may be considered for an extension of the deadline for submission of E- EOI, E-Proposal, bid closing time, or organization to survey PPP project interest, invite interest in investment projects using land, organize online prequalification."
Accordingly, in the near future, investors will be selected through the national bidding network system according to the principles specified above.
Circular 10/2022/TT-BKHDT will take effect from August 1, 2022.
