Procedures for Appointment and Nomination of Positions Managed by the Politburo and the Secretariat as Stipulated

Based on Article 20 of the Regulation 80/QD-TW 2022, the procedures for the appointment and nomination of positions managed by the Politburo and the Secretariat are stipulated as follows:

Based on the number of positions that need to be completed and supplemented, as well as the requirements for performing political tasks, the Party committee, party organization, agencies, and units under the Central authority (hereinafter collectively referred to as the collective leadership) carry out the following tasks:

- Issue documents to submit to the competent authorities for consideration and approval regarding the number of positions that need to be completed and supplemented, including the expected assignment of specific fields and tasks; the rank promotions to General, Senior Lieutenant General, Admiral of the Navy must be submitted for policy approval by the Politburo before personnel processes are carried out.

- After the policy is approved, at the latest within 30 working days, the local collective leadership, agencies, and units must complete the personnel process as prescribed. If the personnel process is not completed within the prescribed time, the collective leadership must clearly explain the reasons and report to the Politburo and the Secretariat for review (through the Central Organization Committee).

- Propose specific personnel.

- Personnel appraisal:

+ The Party committee, party organization, agencies, and units prepare documentation and proposals for appointments to be sent to the Politburo and the Secretariat (through the Central Organization Committee) for personnel appraisal.

+ Within no more than 5 working days from the receipt of the full proposal and personnel documentation as prescribed, the Central Organization Committee sends documents (including copies of personnel files) requesting appraisal opinions from the Party committees, Party delegations, and relevant agencies and units as per the regulations.

+ Within 10 working days, the functional agencies must review and appraise the personnel and provide a written reply to the Central Organization Committee. If there is no written reply within the above timeframe, it is considered as an agreement with the appointment proposal. If additional time is needed for review, verification, or inspection due to objective reasons, a written notice must be sent to the Central Organization Committee for monitoring, but not exceeding 15 working days.

+ Within no more than 10 working days, the Central Organization Committee is responsible for summarizing appraisal opinions or verification, inspection (if any) and issuing a proposal submission for the Politburo and the Secretariat to review and decide.

+ The Politburo and the Secretariat review and decide according to the work program. If a meeting is not organized, in necessary cases, voting slips can be sent to ask for the opinion of the Politburo and Secretariat members.

+ Within no more than 2 working days from the date of the Politburo and the Secretariat’s conclusion, the Central Office of the Communist Party drafts the appointment decision for the Politburo and the Secretariat to sign or announces the conclusion of the Politburo and the Secretariat to relevant agencies for implementation of the appointment or nomination as prescribed. The Central Organization Committee announces salary ranking or positional allowances for the leadership according to the appointed position.

Responsibility and Authority of the Secretariat in Appointments and Nomination of Officers

Based on Article 7 of the Regulation 80/QD-TW 2022 stipulating the responsibilities and authority of the Secretariat in appointments and nomination of officers:

Responsibilities and Authority of the Secretariat

1. Decide on the evaluation, planning, training, fostering, assignment, appointment, nomination for election, re-election, designation, rotation, secondment of officers; promotion, demotion, stripping of military ranks for Generals; relieving from positions, temporary suspension, suspension from positions, resignation, dismissal, termination; commendation, discipline; and implement policies towards the officer positions mentioned in Section II, Appendix 1 of this Regulation.

2. Decide to inspect and supervise the personnel work per the authorization of the Politburo.

3. Periodically report to the Politburo on issues related to personnel work and the officers under the management of the Secretariat.

4. Authorize the following officials: State President, Prime Minister the Government of Vietnam, National Assembly Chairman, Standing member of the Secretariat to review within their respective areas:

- Decide on the assignment, appointment, nomination for election for officers managed by the Secretariat to hold concurrent positions in the Vietnam Fatherland Front, political-social organizations, parliamentary friendship organizations of Vietnam with other countries, and directive committees as per regulations.

- Reappoint and implement retirement policies for officers managed by the Secretariat as per regulations.

5. Responsibilities of the Standing member of the Secretariat:

- Preside over the review of election results and decide on the approval of Party Executive Committees, Party Standing Committees, Secretaries, Deputy Secretaries; inspection committees, chairmen, deputy chairmen of inspection committees, and additional elected positions of provincial, city, and subordinate Party executive committees.

- Supplement the designation of executive members, standing committee members of subordinate Party executive committees, members of Party delegations, and subordinates' Party committees as per the Communist Party Charter.

- Provide opinions on the personal secretaries of the Politburo members, Secretariat members, Vice President, Deputy Prime Ministers, and Vice Chairmen of National Assembly.

Thus, the responsibilities and authority of the Secretariat in the appointment and nomination of officers are executed as stipulated above.

Principles of Personnel Management and Appointment, Nomination of Officers

Based on Article 3 of the Regulation 80/QD-TW 2022 stipulating the principles of personnel management and the appointment, nomination of officers as follows:

- The Communist Party centrally leads personnel work and manages the cadre team:

+ Formulate guidelines, policies, standards, regulations, and rules regarding personnel work and leadership, directing the implementation through Party committees, Party organizations, officers, and Party members in agencies and organizations of the political system, state economic organizations, and public service providers.

+ Focus on building the cadre team of the political system; directly manage the cadre team, especially chief leaders of various sectors and levels.

+ Delegate and decentralize the work of personnel management, appointment, nomination to the various levels of Party committees and Party organizations; concurrently regularly inspect and supervise the implementation of various sectors and levels.

- Ensure strict implementation of the principles of democratic centralism, collective decision-making, while fully promoting individual responsibility, especially the leaders in personnel work and management:

+ Issues regarding guidelines, policies, evaluation, planning, training, fostering, assignment, use, appointment, dismissal, relief from position, suspension of positions, rotation, secondment, commendation, and discipline of cadres must be discussed democratically and decided by authorized Party committees, Party organizations, and collective leadership by majority vote. In case of a differing opinion between the leader and the collective opinion of the Party committees, organizations, and leaders of agencies or units, it must be reported to the competent authority for review and decision.

+ The leader of the Party committee, organization, agency, or unit is responsible for proposing and implementing the collective decision on personnel and personnel work within their assigned scope of responsibility.

+ Cadres and Party members must comply with the resolutions and decisions of Party committees and organizations; subordinate Party committees must comply with the decisions of higher-level Party committees regarding personnel and personnel work.
