Differentiation of Cases where Members of Communist Party of Vietnam Violate Regulations on Management, Issuance, and Use of Diplomas and Certificates under Regulation 69 and Regulation 102

What are the differences between Regulation 69 newly issued in 2022 and the previous regulation regarding the behavior of using illegal diplomas and certificates of members of Communist Party of Vietnam?

Which acts of members of Communist Party of Vietnam will be reprimanded for violating the regulations on management, issuance, and usage of diplomas and certificates?

According to Clause 1, Article 35 of Regulation 69-QD/TW of 2022 and Clause 1, Article 22 of Regulation 102-QD/TW of 2017 regarding violations of the regulations on management, issuance, and usage of diplomas and certificates:

1. members of Communist Party of Vietnam violating any of the following cases causing less serious consequences shall be disciplined by reprimand:

a) Falsely declaring or buying, selling, using, gifting, or presenting fake or illegal diplomas, certificates, certifications, recognitions.

b) Notarizing, authenticating, confirming diplomas, certificates, recognitions against legal regulations.

c) Failing to or improperly issuing copies or confirming the legality of issued diplomas, certificates, recognitions.

d) Not creating or incompletely creating dossiers according to regulations as a basis for issuing, managing diplomas, certificates, recognitions.

dd) Having the responsibility to manage diploma and certificate blanks but being negligent, allowing others to exploit and create illegal diplomas, certificates.

e) Failing to direct checks, handle staff, CPV members, officials, and public employees violating the issuance, confirmation, notarization, or purchasing, selling, or using illegal diplomas, certificates, recognitions under their authority

Which acts of members of Communist Party of Vietnam will result in warning or dismissal for violating the regulations on management, issuance, and usage of diplomas and certificates?

According to Clause 2, Article 35 of Regulation 69-QD/TW of 2022 and Clause 2, Article 22 of Regulation 102-QD/TW of 2017 regarding violations of the regulations on management, issuance, and usage of diplomas and certificates:

2. In cases where disciplinary action has been applied according to Clause 1 of this Article but repeated offenses occur, or the first offense causes serious consequences, or in one of the following cases, the disciplinary measure will be a warning or dismissal (if holding a position):

a) Using illegal diplomas, certificates, recognitions to legalize personnel dossiers.

b) Negligently causing the loss or damage of documents under their management responsibility to issue diplomas, certificates, recognitions.

c) Interfering with organizations or individuals for self or others to be recognized or issued with illegal diplomas, certificates, recognitions.

d) Signing, issuing diplomas, certificates, recognitions to unqualified individuals; making decisions or recommending the competent authority to issue diplomas, certificates, recognitions against regulations.

dd) Forging or altering, supplementing falsified information for competent authorities to issue diplomas, certificates to unqualified individuals; altering, supplementing, falsifying content in diplomas, certificates for unlawful acts.

e) Lending, renting, or allowing others to use their diplomas, certificates for recruitment, schooling, promotion exams, appointment, election, or other illegal purposes.

In cases where disciplinary action has been applied according to Clause 1 of this Article but repeated offenses occur, or the first offense causes serious consequences, or in one of the following cases, the disciplinary measure will be a warning or dismissal (if holding a position):

a) Using illegal diplomas, certificates, recognitions to create dossiers for recruitment exams, exams, advanced or professional training, promotion exams, or to be recommended, appointed, elected, awarded or recognized titles by the Communist Party and the State.

b) Negligently causing the loss or damage of document content under their management responsibility to issue diplomas, certificates, recognitions.

c) Interfering with individuals or organizations for self or others to be recognized or issued with illegal diplomas, certificates, recognitions.

d) Signing, issuing illegal diplomas, certificates to unqualified individuals; making decisions or recommending the competent authority to issue diplomas, certificates, recognitions illegally.

dd) Forging or intentionally altering, supplementing falsified information in dossiers to competent authorities to issue diplomas, certificates to unqualified individuals; altering, supplementing, falsifying content in diplomas, certificates for unlawful acts.

e) Allowing others to use their diplomas, certificates in recruitment, schooling, promotion exams, appointment, election, or other illegal purposes

Which acts of members of Communist Party of Vietnam will result in expulsion for violating the regulations on management, issuance, and usage of diplomas and certificates?

According to Clause 3, Article 35 of Regulation 69-QD/TW of 2022 and Clause 3, Article 22 of Regulation 102-QD/TW of 2017 regarding violations of the regulations on management, issuance, and usage of diplomas and certificates:

3. In cases of violating Clauses 1 and 2 of this Article causing very serious consequences or violating one of the following cases, the disciplinary measure will be expulsion:

a) Engaging in recruitment, examination, training but allowing unqualified individuals to use illegal diplomas, certificates, recognitions to participate in recruitment, examination, or promotion exams.

b) Abusing their position and power to cover up for officials, CPV members under management using illegal diplomas, certificates, recognitions.

c) Directly engaging or assisting in producing, distributing, or mediating the distribution of illegal diplomas, certificates, recognitions.

d) Using fake or illegal diplomas, certificates, recognitions to gain employment in agencies or organizations, join the Communist Party, attend school, have plans, be appointed, take promotion exams, meet standards, and conditions in personnel work.

3- In cases of violating regulations in Clauses 1 and 2 of this Article causing very serious consequences or violating one of the following cases, the disciplinary measure will be expulsion:

a) Engaging in recruitment, examination, training but intentionally allowing unqualified individuals to use illegal diplomas, certificates, recognitions to participate in recruitment, examination, or promotion exams.

b) Abusing their position and power to cover up for officials, CPV members under management using illegal diplomas, certificates, recognitions.

c) Directly engaging or assisting in producing, distributing, or mediating the distribution of illegal diplomas, certificates, recognitions.
