What is the list of localities in Region I of Vietnam to apply the latest proposed region-based minimum wages?
Pursuant to the Appendix issued together with the Draft Decree stipulating the region-based minimum wages for employees working under labor contracts, regulations on localities in Region I are as follows:
- The districts and districts of Gia Lam, Dong Anh, Soc Son, Thanh Tri, Thuong Tin, Hoai Duc, Thach That, Quoc Oai, Thanh Oai, Me Linh, Chuong My and Son Tay town of Hanoi city;
- Ha Long city in Quang Ninh province;
- The districts and districts of Thuy Nguyen, An Duong, An Lao, Vinh Bao, Tien Lang, Cat Hai, Kien Thuy in Hai Phong city;
- Districts, Thu Duc city and Cu Chi, Hoc Mon, Binh Chanh, Nha Be districts of Ho Chi Minh city;

Thus, the Draft Decree stipulating the minimum wage for employees working under labor contracts is different from the provisions in Decree 90/2019/ND-CP. The Draft Decree added Ha Long city of Quang Ninh province, Xuan Loc district of Dong Nai province on the list of localities in Region I.
What is the list of localities in Region II of Vietnam to apply the latest proposed region-based minimum wages?
Pursuant to the Appendix issued together with the Draft Decree stipulating the minimum wages for employees working under labor contracts, regulations on localities in Region II are as follows:
- The remaining districts belong to Hanoi city;
- The remaining districts belong to Hai Phong city;
- Hai Duong city in Hai Duong province;
- Hung Yen city, My Hao town and Van Lam, Van Giang and Yen My districts of Hung Yen province;
- Vinh Yen and Phuc Yen cities and Binh Xuyen and Yen Lac districts of Vinh Phuc province;
- The cities of Bac Ninh, Tu Son and the districts of Que Vo, Tien Du, Yen Phong, Thuan Thanh, Gia Binh and Luong Tai in Bac Ninh province;
- Cam Pha, Uong Bi, Mong Cai cities and Quang Yen and Dong Trieu towns in Quang Ninh province;
- The cities of Thai Nguyen, Song Cong and Pho Yen in Thai Nguyen province;
- Hoa Binh city and Luong Son district of Hoa Binh province;
- Viet Tri city in Phu Tho province;
- Lao Cai city in Lao Cai province;
- Nam Dinh city and My Loc district of Nam Dinh province;

Thus, with this arrangement, there will be a change compared to Decree 90/2019/ND-CP when localities such as Quang Yen town, Dong Trieu belong to Quang Ninh province; Hoa Binh city and Luong Son district of Hoa Binh province; Vinh city, Cua Lo town and Nghi Loc and Hung Nguyen districts of Nghe An province; Hoa Thanh town in Tay Ninh province; Vinh Long city and Binh Minh town in Vinh Long province; Bac Lieu city in Bac Lieu province will be placed in Region II.
What is the list of localities in Region III of Vietnam to apply the latest proposed region-based minimum wages?
Pursuant to the Appendix promulgated together with the Draft Decree stipulating the region-based minimum wages for employees working under labor contracts prescribed for localities in Region III as follows:
- The remaining cities under the province (except for the cities directly under the province mentioned in region I and II);
- Kinh Mon town and Cam Giang, Nam Sach, Kim Thanh, Gia Loc, Binh Giang and Tu Ky districts of Hai Duong province;
- Vinh Tuong, Tam Dao, Tam Duong, Lap Thach and Song Lo districts of Vinh Phuc province;
- Phu Tho town and Phu Ninh, Lam Thao, Thanh Ba and Tam Nong districts of Phu Tho province;
- The districts of Viet Yen, Yen Dung, Hiep Hoa, Tan Yen and Lang Giang in Bac Giang province;
- The districts of Van Don, Hai Ha, Dam Ha and Tien Yen in Quang Ninh province;
- Sa Pa town, Bao Thang district of Lao Cai province;
- The remaining districts belong to Hung Yen province;
- Phu Binh, Phu Luong, Dong Hy and Dai Tu districts of Thai Nguyen province;
- The remaining districts belong to Nam Dinh province;

- Nam Can, Cai Nuoc, U Minh and Tran Van Thoi districts of Ca Mau province;
- Le Thuy, Quang Ninh, Bo Trach and Quang Trach districts and Ba Don town in Quang Binh province.
Accordingly, with the latest proposal, there will be a change compared to Decree 90/2019/ND-CP when arranging localities such as Van Don, Hai Ha, Dam Ha, Tien Yen districts in Quang Ninh province; The districts of Quynh Luu, Yen Thanh, Dien Chau, Do Luong, Nam Dan, Nghia Dan and the towns of Thai Hoa and Hoang Mai in Nghe An province; Mang Thit district, Vinh Long province; Hoa Binh district, Bac Lieu province on the list of localities in Region III.
Thus, the localities that are not in the list of regions I, II and III listed above will be in region IV.
What is the principle of applying the localities in determining the region-based minimum wages according to the latest proposal in Vietnam?
Pursuant to the Appendix promulgated together with the Draft Decree stipulating the minimum wage for employees working under labor contracts, the following provisions are made:
“II. Principles of application of the localities
1. An employee working for an employer operating in a locality shall apply the minimum wage rate prescribed for that locality.
2. An employee working for an employer with units or branches operating in different localities with different minimum wages, the region-based shall apply according to each locality of the branch/unit.
3. An employee working for an employer operating in industrial parks or export processing zones located in different localities with different region-based minimum wages shall apply according to the locality with the highest minimum wages.
4. An employee working for an employer operating in a locality where there is a change of name or separation, shall temporarily apply the prescribed minimum wage for the locality before the name change or division of the employer. until the Government has new regulations.
5. An employee working for an employer operating in a newly established locality from one locality or many different localities with different minimum wages, the minimum wage according to the locality with the same salary level shall apply. highest minimum.
6. An employee working for an employer operating in a locality that is a city directly under a province newly established from a locality or many localities in Region IV then the minimum wage prescribed for the remaining provincial cities in Clause 3, Section I of this Appendix shall apply.”
Accordingly, the application of the region-based minimum wages will be based on the location of the employer's operation. In case an employee works for an employer operating in an industrial park located in localities with different region-based minimum wages, the highest region-based minimum wages will apply.
