“Article 3. Interpretation of terms

- Land change registration, properties attached to land (hereinafter referred to as change registration) is the procedure for recording changes in one or several registered information in the cadastral records as prescribed by law.”*

What are cases of land change registration in Vietnam?
Based on Clause 4, Article 95 of the Land Law 2013 as stipulated:
“Article 95. Land registration, housing, and other properties attached to land
...
- Change registration is performed for cases where a Certificate has been issued, or registration has been made, which has the following changes:
a) The land user, owner of properties attached to the land exercises the rights of exchange, transfer, lease, sublease, inheritance, gift of land use rights, properties attached to the land; mortgage, capital contribution using land use rights, properties attached to the land;
b) The land user, owner of properties attached to the land is allowed to change names;
c) There are changes in the shape, size, area, parcel number, parcel address;
d) There are changes in the properties attached to the land compared to the registered content;
đ) Changing the land use purpose;
e) There are changes in the land use term;
g) Changing from annual land rent to one-time land rent payment for the entire lease term; changing from land allocation without land levy to land rent; changing from land rent to land allocation with land levy according to this Law;
h) Transferring the land use rights, ownership rights of housing, and other properties attached to land between husband and wife;
i) Dividing or consolidating land use rights, ownership rights of housing, and other properties attached to land of organizations, households, husband and wife, or groups of land users, co-owners of properties attached to land;
k) Changing land use rights, ownership rights of properties attached to land according to the result of dispute resolution recognized by competent People's Committees; agreement in mortgage contracts to handle debt; decisions of competent state agencies on resolving land disputes, complaints, or denunciations of land; decisions or judgments of People's Courts; enforcement decisions of enforcement agencies that have been executed; documents recognizing auction results of land use rights following the law;
l) Establishing, changing, or terminating the rights to use limited adjacent parcels;
m) There are changes regarding restrictions on the land user's rights.”*
Cases specified as above must proceed with land change registration.
