Acts to discriminate or retaliate against reporting on doping activities are violations?
Doping is understood as the use of substances or methods by athletes to increase their ability and performance in competition. According to the opinion of the European Olympic Committee and the American Olympic Committee, doping currently has three forms: muscle doping, blood doping, and nerve doping.
In general, doping is prohibited in sports competition.
Pursuant to Circular No. 01/2023/TT-BVHTTDL providing amendments to Circular No. 17/2015/TT-BVHTTDL dated December 30, 2015 of Minister of Culture, Sports and Tourism of Vietnam on anti-doping in sports.
In Clause 1, Article 1 of Circular No. 01/2023/TT-BVHTTDL, the violation of the World Anti-Doping Code is added in Clause 11 Article 4 of Circular No. 17/2015/TT-BVHTTDL as follows:
Amendments to Circular No. 17/2015/TT-BVHTTDL dated December 30, 2015 of Minister of Culture, Sports and Tourism of Vietnam on anti-doping in sports
1. Clause 11 is added to Article 4 as follows:
“11. Acts to discriminate or retaliate against reporting on doping activities.”
Thus, according to the above provisions, acts to discriminate or retaliate against reporting on doping activities is added as one of the violations of the World Anti-Doping Code.

What are the current anti-doping rules in Vietnam?
Pursuant to the provisions of Article 3 of Circular No. 17/2015/TT-BVHTTDL, in sports competition, the anti-doping is carried out according to the following rules:
- Anti-doping activities shall be carried out regularly with attaching special importance to information dissemination and education to increase awareness about consequences of doping.
- Promote close and effective cooperation between domestic and foreign organizations and individuals, and international sports organizations in anti-doping.
- Ensure the compliance with regulations of the World Anti-Doping Agency (WADA) and domestic law regulations of Vietnam in respect of anti-doping in sports.
- Ensure that athletes can train and compete in a clean sports environment and are provided with adequate information about consequences of doping.
How are current doping violations handled?
Pursuant to Article 15 of Circular No. 17/2015/TT-BVHTTDL as follows:
Sanctions for anti-doping rule violations at sports unions or associations
1. Within 07 days from the receipt of the decision on anti-doping rule violation, the competent authority or the national sports union or association shall issue a sanction imposition decision which includes the following information: sanctions, the period of ineligibility which is determined according to the seriousness of the violation, and additional sanctions according to the union or association's internal regulations.
2. The sanction imposition decision issued by the national sports union or association shall be sent to the relevant athlete, Vietnam Sports Administration, Vietnam Anti-doping and Sports Medicine Agency and relevant authorities in accordance with specialized regulations on anti-doping in sports.
3. The national sports union or association shall be responsible for monitoring and submitting, on a periodical basis of every 6 months, reports on training, competition and other professional activities of the athlete during his/her disciplinary period.
Thus, the handling of doping violations at federations and associations is carried out as follows:
- The competent authority or the national sports union or association shall issue a sanction imposition decision which includes the following information: sanctions, the period of ineligibility which is determined according to the seriousness of the doping violation.
According to that, the sanction imposition decision includes the following information: sanctions, the period of ineligibility which is determined according to the seriousness of the violation, and additional sanctions according to the union or association's internal regulations.
- The sanction imposition decision issued by the national sports union or association shall be sent to:
+ The relevant athletes
+ Vietnam Sports Administration
+ Vietnam Anti-doping and Sports Medicine Agency
+ Relevant authorities in accordance with specialized regulations on anti-doping in sports.
Thus, within 21 days from the day on which the sanction imposition decision is received, the athletes, relevant individuals and organizations have the right to lodge a professional complaint against the sanction imposition decision.
Circular No. 01/2023/TT-BVHTTDL takes effect from April 15, 2023.
