When is the land price list in Vietnam adjusted?
According to the provisions of Article 14 of Decree No. 44/2014/ND-CP, the cases of adjustment of the land price list are prescribed as follows:
Adjustment of the land price list
1. Cases in which the land price list is adjusted:
a) The land price bracket adjusted by the Government increases by 20% or more in comparison with the maximum land price or decreases by 20% or more in comparison with the minimum land price in the land price list of the similar land.
b) The common market price of land increases by 20% or more in comparison with the maximum land price or decreases by 20% or more in comparison with the minimum land price in the land price list after 180 days.
Thus, the land price list will be adjusted when:
- The land price bracket adjusted by the Government increases by 20% or more in comparison with the maximum land price or decreases by 20% or more in comparison with the minimum land price in the land price list of the similar land.
- The common market price of land increases by 20% or more in comparison with the maximum land price or decreases by 20% or more in comparison with the minimum land price in the land price list after 180 days.
At the same time, when the above cases occur, according to Article 22 of Circular No. 36/2014/TT-BTNMT, the Department of Natural Resources and Environment is responsible for organizing the implementation of the following contents:
- Plan the land price list adjustment project in accordance with Article 10 of Circular No. 36/2014/TT-BTNMT; provide instructions on surveys into market land prices with regard to each type of land, location, and areas where land prices are fluctuating;
- Select an organization licensed to provide consultancy on land pricing to execute the land price list adjustment project in accordance with law.

What are the procedures for adjusting the land price list in Vietnam?
The order of adjusting the land price list shall comply with the provisions of Clause 4, Article 14 of Decree No. 44/2014/ND-CP as follows:
Step 1. Defining the land type, the location needing adjustment in the land price list;
Step 2. Investigating, analyzing, synthesizing the information about the market price of land, the natural, economic, and social factors, management and use of land that affect land prices;
Step 3. Analyzing, evaluating the result of the implementation of the current land price list.
Step 4. Formulating the adjusted land price list and making a written request for the promulgation of the adjusted land price list;
Step 5. Conducting a survey into the adjusted land price list;
Step 6. Completing the draft land price list and submitting it to the People’s Committee of the province.
Step 7. Verifying the draft of the adjusted land price list;
Step 8. Submitting the draft of the adjusted land price list to the Permanent People’s Council at the same level for approval and reporting it to the People’s Council in the upcoming meeting.
Step 9. Promulgating the adjusted land price list.
What is included in the application for the adjustment to the land price list in Vietnam?
According to the provisions of Clause 5, Clause 6 and Clause 7, Article 14 of Decree No. 44/2014/ND-CP as follows:

5. Application for the adjustment to the land price list submitted to the People’s Committee of the province consists of:
a) A written request for the promulgation of the adjusted land price list
b) The draft of the adjusted land price list;
c) A description of the compilation of the adjusted land price list;
d) A record of the inspection of the adjusted land price list.
6. Application for the adjustment land price list submitted to the Permanent People’s Council of the province for approval consists of: a written request of the People’s Committee of the province, the draft of the adjusted land price list and a description of the adjusted land price list.
7. The Department of Natural Resources and Environment shall formulate the local adjusted land price list and request the People’s Committee of the province to promulgate it.
Thus, the Department of Natural Resources and Environment is responsible for organizing the construction and submitting to the People's Committee of the province the application for the adjustment to the land price list as follows:
- A written request for the promulgation of the adjusted land price list
- The draft of the adjusted land price list;
- A description of the compilation of the adjusted land price list;
- A record of the inspection of the adjusted land price list.
At the same time, the application for the adjustment land price list submitted to the Permanent People’s Council of the province for approval consists of:
- A written request of the People’s Committee of the province;
- The draft of the adjusted land price list;
- Description of the adjusted land price list.
What are the regulations on compilation of adjusted land price list in Vietnam?
According to the provisions of Article 25 of Circular No. 36/2014/TT-BTNMT as follows:
Compilation of adjusted land price list
1. Compile the land price list with adjusted prices of one, some, or all types of land, or one, some, or all locations (hereinafter referred to as adjusted land price list) in accordance with Clause 1 Article 19 of this Circular.
2. Process prices of adjacent land (if any).
3. Make a report on the compilation of the adjusted land price list.
4. Make a report on the issuance of the adjusted land price list.
5. Seek opinions of relevant entities about the draft and completion of the adjusted land price list.
Thus, the compilation of an adjusted land price list is carried out in accordance with the above provisions.
