How long does it take to notify a positive HIV test result in Vietnam?

Pursuant to Circular 04/2023/TT-BYT stipulating the form and process for notifying positive HIV test results and accessing information on HIV-infected people issued by the Ministry of Health on February 28, 2023.

The time for notifying positive HIV test results shall comply with the provisions of Article 3 of Circular 04/2023/TT-BYT. As follows:

The notification of positive HIV test results must be made within 72 working hours after the person responsible for notifying the test results where the patient is sampled receives the positive HIV test result, except for the following two cases:

- The person being tested for HIV does not come to receive the test results.

- The person being tested for HIV has not been able to receive information about his/her own HIV-positive status due to lack of health. The person responsible for notifying the HIV-positive test result chooses an appropriate time to notify the person being tested.

What is the regulation on notification of positive HIV test results in Vietnam?

According to Article 4 of Circular 04/2023/TT-BYT, Article 30 of the Law on HIV/AIDS Prevention and Control 2006 is amended by Clause 10, Article 1 of the revised Law on HIV/AIDS Prevention and Control 2020. Method of receiving notification of examination results positive HIV test for each subject is done as follows:

- Directly notify and return positive HIV test results to the following subjects:

+ The person being tested;

+ The spouse of the person being tested; father, mother or guardian, representative of the person being tested is a person under 18 years old, a person who has lost his/her civil act capacity, a person with difficulties in cognition and behavior control, and a person with limited capacity civil actions;

- Directly notify or return positive HIV test results to the following subjects:

+ Persons assigned the task of directly counseling and notifying positive HIV test results to the tested persons;

+ Heads of agencies or units tasked with HIV/AIDS epidemiological surveillance; the person assigned the task of monitoring HIV/AIDS epidemiology;

+ The head, chief nurse of a department, room or other unit of a health facility where HIV-infected people are treated; health workers assigned to directly treat and care for HIV-infected people at health facilities;

- Return the positive HIV test result card to the following subjects:

+ Heads, persons in charge of health, health workers assigned to directly provide health care for HIV-infected people at compulsory education institutions, reformatories, drug rehabilitation establishments, establishments social protection, detention camps, detention camps, detention houses and other detention facilities;

+ Heads and cadres and civil servants assigned responsibilities of investigating bodies, people's procuracies or people's courts.

- Other appropriate forms of notification at the request of the person being tested for HIV.

How to make, send, deliver and receive positive HIV test results in Vietnam?

Pursuant to Clause 2, Article 2 of Circular 04/2023/TT-BYT, the positive HIV test result sheet is prepared according to the provisions in the Appendix to the positive HIV test result form attached to Circular 04/2023/TT-BYT.

In which, the positive HIV test result sheet is made in at least 03 copies:

- 01 copy is kept at the establishment designated to test positive HIV;

- 01 copy is kept at the HIV-positive testing facility;

- 01 copy to be returned to the person being tested for HIV.

According to the provisions of Clause 3, Article 2 of Circular 04/2023/TT-BYT, the delivery, delivery and receipt of positive HIV test result sheets are carried out as follows:

- Transfer, hand over and receive positive HIV test result sheets between departments and rooms in a medical facility:

The head of the testing facility is responsible for developing the process of sending, handing and receiving the vouchers in each medical facility to ensure the confidentiality of test results, information and HIV infection status of the person being tested for HIV;

- Transfer, deliver and receive the HIV-positive test result sheet from the HIV-affirming testing facility to the responsible person specified in Clause 2, Article 30 of the Law on HIV/AIDS Prevention and Control 2006 as amended by Clause 10, Article 1 of the Law on amendments to the Law on prevention and control of HIV/AIDS 2020:

The result must be put in a sealed envelope, clearly stating the name of the agency, organization, individual, address, phone number (if any) and the seal of the testing facility where the ballot is sent;

- Transfer the positive HIV test result slip through the hospital information management system or HIV/AIDS information management system.

Circular 04/2023/TT-BYT takes effect from May 1, 2023.
