Who are included in the Commendation and Reward Council of the People's Court, and the basic Commendation and Reward Council?

Pursuant to Clause 2, Article 36, and Clause 2, Article 37 of Circular 01/2024/TT-TANDTC, the composition of the Commendation and Reward Council is specified as follows:

(1) The composition of the Commendation and Reward Council of the People's Court includes:

- The President of the Council is the Chief Justice of the Supreme People's Court;

- The Council has from 03 to 05 Vice Presidents. The head of the Permanent Unit of the Commendation and Reward Council of the People's Court is the Standing Vice President, other Vice Presidents are decided by the President of the Council;

- Council members are representatives of the leadership: the party committee, the trade union of the Supreme People's Court, and some units under the Supreme People's Court.

(2) The composition of the basic Commendation and Reward Council includes:

- The President of the Council is the head of the agency or unit;

- The Council has no more than 04 Vice Presidents. The head of the unit who is responsible for assisting the head of the agency or unit with commendation and reward work is the Standing Vice President, other Vice Presidents are decided by the President of the Council;

- Council members are representatives of the leadership: the party committee, the trade union, and some minor units under the agency or unit (for the Commendation and Reward Council of the Provincial People's Court, there are from 01 to 02 members who are Chief Justices of the District People's Court).

The Commendation and Reward Council of the People's Court is established by the Chief Justice of the Supreme People's Court. The basic Commendation and Reward Council (Judicial Academy, Justice Newspaper, Judicial Journal, High People's Court, Provincial People's Court) is established by the heads of the agencies or units with the above-mentioned composition.

What are the principles of rewards in the People's Court?

According to Article 5 of Circular 01/2024/TT-TANDTC, the principles of rewards in the People's Court are regulated as follows:

- Democratic, accurate, public, transparent, fair, and prompt.

- A form of reward can be given multiple times to an individual; do not reward multiple times or in multiple forms for one achievement; reward achievements as they come.

- Do not award two forms of reward (including titles) to an individual for the same achievement; except in cases of exceptional, sudden achievements, rewarding for contributions, or periodical rewards in the armed forces (if any).

The result of sudden achievement rewards and thematic emulation is not used as a basis for recommending higher-level commendations.

- Ensure consistency between the nature, form, and object of the reward.

- Closely combine spiritual encouragement with material incentives.

- Annual rewards should be based on the evaluation and classification results of individuals and collectives (according to the regulations of the Communist Party, laws on review and annual quality evaluation of individuals and collectives in the political system, and regulations of the Supreme People's Court).

- Rewards must be based on the achievements attained.

+ Achievements gained under difficult conditions and with a wide impact are rewarded at a higher level.

+ Only the final year's achievements reward results are used as the basis for considering rewards or recommendations for rewards (thematic emulation rewards are recorded and prioritized when considering rewards or recommending higher-level rewards).

+ Do not accumulate previously rewarded achievements to recommend a higher reward level later. Focus on rewarding small collectives and individuals who directly labor, work, fight, and have many innovations in their work.

- When rewarding the head of an agency or unit, the reward must be based on the collective achievements led by that individual (the reward level for the head is not higher than that of the collective led by that individual in the working year).

If awarding based on judge criteria, follow the general criteria for judges in the agency or unit.

- Do not reward or recommend higher-level rewards for individuals or collectives during the investigation, inspection, or review period by competent authorities for disciplinary actions or other violations, or under complaint, denunciation, or corruption investigation by the press that is still under clarification.

In cases where individuals or collectives are disciplined, after serving the disciplinary period, if they achieve merits, the reward is calculated from the time they finished serving the disciplinary period.

- Individuals or collectives are not considered for a reward if they have a judgment, decision annulled, or modified, but later the appellate review board concludes the annulment or modification was inaccurate, they can be considered for additional rewards.

- Do not reward collectives with officials and public employees, laborers who have been disciplined from the warning level upward or are under criminal prosecution.

Collectives with officials and public employees, laborers disciplined with a reprimand can still be considered for reward if they meet other reward conditions and criteria; the same level Commendation and Reward Council considers, recommends, and the head of the agency or unit decides on the recognition of merit titles and reward forms according to authority.

- For female leaders and managers, the period of holding a position for considering a reward for contributions is reduced by 1/3 compared to the general regulation (if the retirement age is higher, the period of holding a position for considering a reward follows the general regulation).

When there are many individuals and collectives with the same conditions and criteria for one form of reward, priority is given to female individuals, and collectives with higher female ratios.

- The next reward consideration time is calculated from the achievement timing recorded in the previous reward decision.

For reward decisions not recording the achievement timing, the next reward consideration time is calculated from the issuance of the previous reward decision.

- The level initiating the emulation movement, when summarizing and selecting examples, rewards or recommends higher-level rewards (for exceptional, standout achievements with broader impact).

- When calculating the number of individuals or collectives, if the result is a decimal, round the number: Below 0.5 is calculated as 0, from 0.5 is calculated as 1.

What forms of emulation organization exist in the People's Court?

Pursuant to Article 7 of Circular 01/2024/TT-TANDTC, forms of emulation organization are regulated as follows:

Forms of emulation organization

1. Regular emulation is based on the assigned functions and duties of individuals and collectives to launch, aiming to perform daily, monthly, quarterly, and yearly work of the agency or unit.

The target of regular emulation includes individuals within a collective; collectives within the same agency or unit; agencies, units with similar or nearly similar functions, duties, and job nature.

Organizing regular emulation must clearly define objectives, requirements, goals, specific targets and be implemented at the agency, unit, or emulation cluster to build plans, launch, sign agreements, and organize the emulation movement. At the end of the working year, the head of the agency or unit, the Head of the emulation cluster summarizes the emulation movement, considers awarding or recommending merit titles and reward forms.

2. Thematic emulation aims to perform key duties identified within a certain period or organize emulation to strive to complete sudden, urgent tasks of the agency or unit.

An agency or unit launches thematic emulation only when clear objectives, requirements, targets, content, solutions, and implementation time are identified. When organizing thematic emulations within the agency or unit, the head guides reward consideration according to authority. For thematic emulations within the People's Court with a period of 03 years or more, the Supreme People's Court sends an emulation movement organization plan to the Ministry of Home Affairs (through the Central Emulation - Reward Committee) for compilation and reward consideration guidance.

Thus, there are 2 forms of emulation organization in the People's Court: Regular emulation and thematic emulation.

Circular 01/2024/TT-TANDTC takes effect from June 11, 2024.
