What are the components of a dossier of application for appointment of forensic examiners and forensic psychiatrists in Vietnam?
According to the provisions of Article 4 of Circular 11/2022/TT-BYT of Vietnam on dossiers of application for appointment of forensic examiners and forensic psychiatrists in Vietnam:
- A written request for appointment of a forensic medical examiner or forensic psychiatrist from a competent agency or organization and a list of excerpts made according to the form provided in Appendix 1 to this Circular.
- Certified copies of diplomas and certificates according to the criteria for appointment of forensic examiners and forensic psychiatrists specified in Clause 1, Article 3 of this Circular.
Diplomas issued by foreign educational institutions must be recognized for use in Vietnam in accordance with an agreement or agreement on degree equivalence or mutual recognition of qualifications or under international treaties related to the diploma that the Socialist Republic of Vietnam has signed.
- A curriculum vitae, made according to the form prescribed in Appendix 2 issued with this Circular, with a 4cm x 6cm color portrait photo taken no more than 06 months before the application deadline, stamped with border seal and certified by the competent state agency.
- Certificate of actual time of professional activities in the field of training or certificate of time directly assisting in assessment activities at a forensic medical examination organization or forensic psychiatric assessment organization in accordance with professional qualifications in the field of training of the agency or organization where the person proposed to work is made according to the form specified in Appendix 3 to this Circular.
- A copy of the certificate of professional training as prescribed in Clause 2, Article 3 of this Circular.
- Two color portrait photos of size 2cm x 3cm taken no more than 6 months before the application deadline (for the assessment of the examiner's card).

What are the procedures for appointing provincial-level examiners?
According to the provisions of Clause 2, Article 5 of Circular 11/2022/TT-BYT of Vietnam, the procedures for appointment and issuance of cards of provincial-level forensic examiners and forensic psychiatrists as follows:
- Provincial police, provincial forensic center, and medical facilities under the management of the Department of Health shall select people who fully meet the criteria specified in Article 3 of this Circular, and guide individuals to complete the supplementary dossiers. Forensic examiners, forensic psychiatrists according to the provisions of Article 4 of this Circular, shall be sent to the provincial Department of Health.
- The Department of Health shall assume the prime responsibility for, and coordinate with the Department of Justice in, reviewing the application for appointment of forensic examiner, forensic psychiatrist.
Within 20 days from the date of receipt of a complete and valid dossier, the Department of Health shall submit it to the President of the provincial People's Committee for consideration and decision on appointment of a forensic medical examiner or a forensic psychiatrist according to regulations of the law. In case of ineligibility for appointment, the Department of Health shall notify the agency or unit requesting appointment in writing, clearly stating the reason.
- Within 10 days from the date of issuance of the decision to appoint forensic and forensic psychiatrists, the Ministry of Health and the provincial-level People's Committees are responsible for making and posting a list of forensic examiners, forensic psychiatrists on the web portal of the ministry, the provincial People's Committee, and at the same time send it to the Ministry of Justice to make a general list of judicial examiners in accordance with law.
- Agencies competent to appoint forensic experts and forensic psychiatrists shall issue and re-issue examiner cards. The issuance of new examiner cards shall be carried out concurrently with the appointment of examiners.
Card form, order and procedures for new issuance and re-issuance of the card of forensic examiner and forensic psychiatrist shall comply with the provisions of Circular No. 11/2020/TT-BTP dated December 31, 2020 of the Ministry of Justice stipulating the card model, order and procedures for granting and re-granting judicial examiner cards.
- Agencies competent to appoint forensic experts and forensic psychiatrists are responsible for allocating funds to pay for the making of examiner cards, guaranteed from the state budget according to the annual estimate of the unit in accordance with the law on state budget.
Is the person proposed to appoint a forensic examiner required to have a medical university degree?
According to the provisions of Clause 1, Article 3 of Circular 11/2022/TT-BYT of Vietnam, the person proposed to appoint a forensic expert must have a university degree or higher in one of the training specialties specified in this Circular No. 09/2022/TT-BGDDT dated June 6, 2022 of the Ministry of Education and Training stipulating the list of statistics of training majors of higher education suitable for each field of assessment, specifically:
- For the person proposed to appoint a forensic expert:
Group of medical training majors (except for preventive medicine training) for persons performing forensic examination.
Group of training majors in pharmacology, training in chemistry for those performing forensic examination of toxicology.
The group of biomedical and applied biology training majors for those performing forensic examination in the biomedical field.
Group of training disciplines suitable to other fields of forensic examination.
- For the person who is proposed to appoint a forensic psychiatrist: is a doctor with general medical training who has been granted a certificate or certificate of professional training in psychiatry for 6 months or more at the training institution with the function of providing specialized training in psychiatry; or a doctor who has been granted a graduate degree in psychiatry (Specialized Level 1 doctor, Specialized Level 2 doctor, resident doctor, master, PhD doctor).
