In Subsection 2.1, Section IV, Resolution 18-NQ/TW of 2022 on "Ongoing innovation and improvement in regulatory institutions and policies; enhancement of efficiency and effectiveness in management and use of land, serving as the driving force in developing our country into a high-income economy," issued by the Central Committee of the Communist Party of Vietnam, is stated as follows:
"- National planning, land use planning, and sector plans involving land use must be ensured to be appropriate, consistent, synchronized, and interlinked to promote mutual development.
- land use planning schemes and plans are made at the national, provincial, and district levels, meeting the requirements for quickly and sustainably implementing the socio-economic development strategy; ensuring national defense, security; environmental protection, and adaptation to climate change.
- The content of land use planning must integrate land type indicators with space, land-use zoning, natural ecosystems, and inform each parcel.
- Determining land use indicators must meet land use needs, avoiding waste in the allocation, management, and use of land.
- Clearly and strictly regulate the annual land use plan approval and issuance.
- The state ensures sufficient resources to prepare land use planning and sector plans involving land use."

What are the principles for preparing land use planning schemes and plans in Vietnam?
In Article 35 of the Land Law 2013 (amended by Clause 1, Article 6 of the Law amending and supplementing a number of provisions of 37 laws related to planning, 2018) as follows:
"Article 35. Principles for Preparing land use planning schemes and plans
1. The preparation of land use planning must comply with the regulations of the law on planning and the following principles:
a) National land use planning must ensure the specificity and connectivity of regions; district-level land use planning must reflect the land use content of the commune level;
b) Strict protection of land specialized in rice cultivation, protection forests, and special-use forests;
c) Ensuring the balance between the land use needs of various sectors, fields, and localities and the national land fund to use land economically and efficiently;
d) Reasonable exploitation of natural resources; adaptation to climate change;
đ) The content of land allocation and use in the national sector, regional, and provincial planning must be consistent with national land use planning.
2. The preparation of land use plans must comply with the following principles:
a) Be consistent with the socio-economic development strategy, national defense, and security plans;
b) Land use plans must be consistent with land use planning at the same level approved by competent state agencies; for provincial-level land use plans, they must be consistent with the provincial land allocation and zoning scheme;
c) Use land economically and efficiently;
d) Reasonable exploitation of natural resources and environmental protection; adaptation to climate change;
đ) Protect and promote historical-cultural relics and scenic spots;
e) Plans of sectors, fields, and localities involving land use must be consistent with the land use planning schemes and plans approved by competent state agencies."
What are the regulations on land use planning schemes and plans in Vietnam?
According to Article 38 of the Land Law 2013 (amended by Clause 1, Article 6 of the Law amending and supplementing a number of provisions of 37 laws related to planning, 2018) as follows:
"Article 38. National land use planning schemes and plans
1. The bases for preparing national land use planning include the bases as prescribed by the law on planning and the following bases:
a) Natural, economic, and social conditions;
b) Current land use status, land potential, and results of implementing the national land use planning in the previous period;
c) The land use needs of sectors, fields, and provincial administrations.
2. The content of national land use planning shall be implemented as prescribed by the law on planning.
3. The bases for preparing national land use plans include:
a) National land use planning;
b) The 5-year and annual socio-economic development plans of the whole country;
c) The 5-year land use needs of sectors, fields, and provincial administrations;
d) The results of implementing the national land use plan in the previous period;
đ) The capacity to invest and mobilize resources for the implementation of the land use plan.
4. The content of the national land use plan includes:
a) Analyze and evaluate the implementation results of the national land use plan in the previous period;
b) Determine the area of land types in the national land use planning for each 5-year land use plan period;
c) 5-year land use plans for each socio-economic region and provincial administrative unit;
d) Solutions for implementing the land use plan."
Thus, based on current regulations and practical situations, the Central Committee has proposed tasks and solutions for innovating and improving the quality of land use planning schemes and plans.
