On January 18, at the National Assembly, under the chairmanship of National Assembly Chairman Vuong Dinh Hue, the National Assembly of Vietnam concluded its 5th extraordinary session. With the majority of votes in favor, the National Assembly of Vietnam passed the amended Land Law.

Sharing with reporters at the press conference on the results of the 5th extraordinary session of the 15th National Assembly (January 18), Permanent Member of the National Assembly's Economic Committee Phan Duc Hieu stated that there are hundreds of new points in the amended Land Law that has just been passed, including 05 groups of important points of issues that impact the people and the business community.

Regarding the new points in the amended Land Law that the National Assembly of Vietnam has just passed, Permanent Member of the National Assembly's Economic Committee Phan Duc Hieu affirmed: "If we list them in detail, there are hundreds of new points in the amended Land Law, but in my personal research, there are 5 new groups of issues":

The first group of issues is related to regulations aimed at better protecting the rights and legitimate interests of land users. This group has many provisions, such as expanding land use rights, land access for Vietnamese citizens, land policies for ethnic minorities.

The second group of issues is related to land access for people and businesses, which includes many new regulations, such as land appropriation for economic and social infrastructure, land appropriation for production and business - this is newly designed, fully institutionalized in Article 54 of the Constitution, and is only applicable in necessary cases; expanding regulations related to land agreement mechanisms, land use conversion, and landowners; expanding land funds; land funds for small and medium-sized enterprises; land resources for social housing construction.

The third group of issues is related to regulations to enhance the efficiency of land use. This includes provisions on multi-purpose land use; limiting and narrowing the cases requiring permission; issues related to the transfer of agricultural land to increase opportunities for large-scale production accumulation; issues related to the transfer of rice-growing land to non-agricultural production.

The fourth group of issues, related to land finance, has separated the issue of land valuation; land support policies and exemptions; some policies to stabilize land rent as an input activity for production and business.

The fifth group of issues, the new regulations aim to improve the effectiveness and efficiency of state land management, in which the notable point is streamlining administrative procedures, creating favorable conditions for the people and businesses, for example, issues related to the transfer of real estate projects, extension of agricultural land.

In addition, Permanent Member of the National Assembly's Economic Committee Phan Duc Hieu also stated that one of the important new points in the amended Land Law is to improve the quality and mechanism of land data information for easier and more complete access by the people, serving their lives and production and business.

According to Article 252, Clause 1 of the Land Law 2024, the effectiveness of the enforcement is stated as follows:

Therefore, after being approved in the extraordinary session of the National Assembly on January 15, 2024, the Land Law 2024 is expected to take effect from January 1, 2025, except for the provisions stated in Clause 2 and Clause 3 of Article 252 of the Land Law 2024.

What is the content of state management of land in Vietnam under the amended Land Law?

According to Article 20 of the Land Law 2024, the content of state management of land includes:

(1) Issuing and organizing the implementation of legal documents on land management and use.

(2) Disseminating, promoting, educating, training, conducting scientific research, developing technology, and international cooperation in land management and use.

(3) Determining administrative boundaries, establishing and managing administrative boundary records.

(4) Surveying, adjusting, and establishing cadastral maps, land use status maps, land use planning maps, and specialized maps for land management and use.

(5) Investigating, evaluating, protecting, improving, and restoring land.

(6) Developing, adjusting, and managing land use planning and plans.

(7) Allocating land, leasing land, appropriating land, recognizing land use rights, resuming land, and changing land use purposes.

(8) Surveying, establishing land prices, specific land prices, and managing land prices.

(9) Managing land finance.

(10) Compensating, supporting, and resettling in cases of land appropriation and resumption.

(11) Developing, managing, and exploiting land funds.
