Vietnam: Cases where transport vehicles are not required to have badges and dash cams

According to Decree No. 86/2014/NĐ-CP of Vietnam’s Government, transport business cars are required to have vehicle badges and dash cams; however, if the cars fall into one of the following cases, they are not required to have badges and dash cams.

1. Not falling into the subjects specified at Point a Clause 3 Article 11 and Clause 1 Article 14 of Decree No. 86/2014/NĐ-CP

Article 11. Regulation for driver, transport operator and auto used for transport business

3. Auto for transport business must ensure the following requirements:

a) Auto for passenger transport business along fixed route taxi, bus, auto transporting passenger under contract, auto carrying container, trailer or semi-trailer tractor or auto transporting goods must be attached with a sign; auto for tourist transport business must be attached with token as prescribed by the Ministry of Transport.

 

Article 14. Route monitoring equipment

1. Autos used for passenger transport business or goods transport business in container, trailer or semi-trailer tractor used for transport business and autos used for goods transport business must be installed the route monitoring equipment;

According to Official Dispatch No. 6675/BGTVT-VT dated June 21, 2018, automobiles that do not directly collect money for transport business and are not subject to the issuance of a Cargo Transport Business License under Clause 1 Article 50 of Circular No. 63/2014/TT-BGTVT of the Ministry of Transport of Vietnam are not required to have vehicle badges and dash cams.

Article 50. Requirements for companies providing goods transport service without direct collection of money that must have a Business license

1. A company providing goods transport service without direct collection of money shall obtain the License for automobile transport if such company:

a) Uses vehicles for transporting hazadous goods specified by the Government on list of dangerous goods and provisions regarding transport of hazardous goods and competence to issue License for transport of hazardous goods.

b) Uses vehicles for transporting oversize/overweight goods according to regulations on vehicular weight and dimensional limits of road, use of overloaded vehicles, vehicles exceeding the dimensional limits, tracked vehicles on road, transport of oversized/overweight cargo, limits on goods loaded on road vehicles running on public roads.

c) Owns at least 05 vehicles.

d) Uses a vehicle that has carrier capacity of 10 tonnes or more for transporting goods.

Thus, passenger transport business vehicles and goods transport business vehicles with direct collection of money are required to have vehicle badges and dash cams. In case a car of a freight transport business unit does not collect money directly, it is not eligible for a business license under Clause 1 Article 50 of Circular No. 63/2014/TT-BGTVT of the Ministry of Transport of Vietnam, vehicle badges and dash cams are not required.
