Circular 58: Troubleshooting for Citizens in Vehicle Registration Procedures

On August 1, 2020, Circular 58/2020/TT-BCA stipulating the procedures for issuance, revocation of registration, and license plates of road motor vehicles officially came into effect. This is good news, as the regulations in the Circular help to resolve difficulties for citizens in vehicle registration procedures.

1. From August 1, 2020, it is possible to perform vehicle registration procedures online (via the internet)

Pursuant to Clause 4, Article 10 of Circular 58/2020/TT-BCA, vehicle owners can carry out vehicle registration online (via the internet). The vehicle registration procedures are performed as follows:

Step 1: The vehicle owner fills in the vehicle and owner information on the vehicle registration form (form No. 01) on the electronic information page of the Traffic Police Department or the national public service portal to register the vehicle online.

Step 2: The vehicle owner receives an order number and appointment schedule to process the documents via email or text message.

Step 3: Officers and soldiers tasked with vehicle registration check the declared information and proceed to register the vehicle.

The vehicle dossier is stipulated in Articles 8 and 9, and the procedure to issue registration and license plates is stipulated in Article 10 of Circular 58/2020/TT-BCA.

Thus, aiming to build the e-Government of Vietnam, the implementation of administrative procedures in general and vehicle registration procedures particularly are gradually shifting to online forms. This primarily facilitates citizens in carrying out procedures and, secondly, helps reduce the burden and pressure on increasingly overloaded public administrative agencies.

To be specific: the online vehicle registration method will be implemented starting from March 1, 2021.

2. The procedure for transferring vehicle ownership in cases where the vehicle has changed ownership through multiple people has become simpler

Article 19 of Circular 58/2020/TT-BCA stipulates the procedure for transferring vehicle ownership in cases where the vehicle has changed ownership through multiple people as follows:

- Procedure and dossier for name transfer: The person using the vehicle goes to the vehicle registration management agency to carry out the name transfer procedure, present documents as required in Article 9 of Circular 58/2020/TT-BCA, clearly stating the process of lawful buying, selling, and vehicle handover, and commit to the origin of the vehicle and submit the following documents:

- The vehicle registration certificate and license plate as stipulated in Clause 3, Article 6 of this Circular;- Documents on vehicle ownership transfer from the person listed in the vehicle registration certificate and documents on vehicle ownership transfer from the last seller (if any).

- Procedure and dossier for name transfer: The person using the vehicle contacts the vehicle registration agency in their residence area, presents the documents as required in Article 9 of this Circular, and submits the following documents:

- Vehicle registration form (according to form No. 01);- Proof of payment of registration fee as required;- The certificate of withdrawal of registration, and license plate (for cases transferring to another province and motorcycles from different vehicle registration points).

Processing time: No more than 2 working days from the date of receipt of complete documents, the vehicle owner will be issued a vehicle registration certificate.

Previously, the procedures for transferring vehicle ownership in cases where the vehicle had changed ownership through multiple people (known as vehicle registration through multiple owners) were quite complicated. Typically, the name transfer registration was divided into the following cases:

- Name transfer registration within the same province;- Name transfer and vehicle relocation to another province;- Name transfer registration from another province.

Dividing into many cases led to difficulties for the people in preparing the necessary documents to fully and accurately complete the vehicle registration procedures.

Also, Circular 58/2020/TT-BCA provides guidance for cases where the vehicle has changed ownership through multiple people but lacks or does not have documents on ownership transfer, registration, or name transfer according to the regulations in Article 19 of this Circular until the end of December 31, 2021.

Previously, as stipulated in Clause 3, Article 34 of Circular 15/2014/TT-BCA, two-wheel motorcycles, three-wheel motorcycles, mopeds (including electric motorcycles), and vehicles with similar structures that had changed ownership through multiple people but lacked or did not have documents on ownership transfer were handled for registration, name transfer until the end of December 31, 2016.

Thus, with the regulations in Circular 58/2020/TT-BCA, the procedures for transferring vehicle ownership in cases where the vehicle had changed ownership through multiple people along with cases where the vehicle does not have documents proving ownership are both detailed and complete, making it much easier for citizens to carry out the procedures.

3. The issuance of replacement or re-issue of lost, blurred, or damaged license plates; lost vehicle registration certificates are carried out according to the procedures stipulated in Circular 58/2020/TT-BCA

According to Circular 58/2020/TT-BCA, the vehicle owner submits the following documents:

- Vehicle registration form according to form No. 01 issued with Circular 58/2020/TT-BCA;- Identity card/Citizen identification card/Household registration book;- Vehicle registration certificate (for replacement of vehicle registration certificate) or license plate (for replacement of license plate).

For vehicles modified to change the engine, frame, additional documents include: Proof of registration fee payment as required, documents on ownership transfer (engine, frame) as required, source documents of the engine and frame.

In general, administrative reforms are aimed at making it more convenient for citizens to perform transactions, and this applies similarly to vehicle registration procedures. With Circular 58/2020/TT-BCA officially taking effect, it is certain that citizens will find it more convenient to carry out vehicle registration procedures.
