Vietnam: Owner of dedicated railways will have to make annual reports

On October 13, 2020, the Minister of Transport of Vietnam issued the Circular No. 24/2020/TT-BGTVT on amendments to certain articles of circulars on periodic reporting regulations in the railway sector.

According to Article 2 of the Circular No. 24/2020/TT-BGTVT of the Ministry of Transport of Vietnam on amendments to Clause 4 Article 24 of Circular No. 24/2018/TT-BGTVT dated May 07, 2018 of the Minister of Transport on formulation of train operation timetable and administration of railway transport, responsibilities of the owner of dedicated railways are prescribed as follows:

- Fulfill all the tasks related to the establishment, publication and adjustment of the timetable, control the transport on dedicated railways prescribed in this Circular; the owner of dedicated railways connected to national railways must provide relevant figures to lay a foundation for the establishment of the timetable such as the load of a train, maximum haul order; time for carrying out professional technical procedures, loading and unloading passengers and cargo at the stations; requirements for transport and train operation of railway transport traders sent to the Vietnam Railway Authority.

- Provide guidelines and verify organizations and individuals under the management in pursuit of satisfying relevant regulations prescribed in Circular No. 24/2018/TT-BGTVT.

- The owner of dedicated railways connected to national railways must cooperate with the national railway infrastructure trader in adjusting the timetable applied to current trains and additional trains running on the railways prescribed in Clause 2 in Article 11 of Circular No. 24/2018/TT-BGTVT when traffic accidents or incidents occur in the dedicated railways connected to national railways, as required.

- Submit reports involving the following contents:

+ Report name: Report on formulation and publishing of the train operation timetable;

+ Required reporting contents: Reports on results of formulation, publication and adjustment of the train operation timetable; difficulties during the implementation; plans and measures for the next year;

+ Reporting entity: Owners of dedicated railways;

+ Receiving authority: Vietnam Railway Authority;

+ Methods of submission and reception of reports: Periodic reports can be physical documents or electronic documents and shall be sent directly or by post, by email or other methods as prescribed by law.

+ Reporting frequency: Annually;

+ Time for finalizing reporting data: From December 15 of the previous year to December 14 of the reporting year.

+ Report outlines: According to Appendix 2 issued with Circular No. 24/2018/TT-BGTVT.
