Vietnam: How much does it cost to make a land use right certificate?

Hello LawNet. My name is Nguyen Minh Phong, I am currently applying for a Land Use Rights Certificate but am not clear about the fees to be paid. I hope LawNet will assist me!

LawNet would like to answer your question as follows:

Amounts payable when carrying out procedures for issuance of Certificates of land use rights (colloquially called "red book" due to the red covers) and assets attached to land include land use levy, registration fees, certification fees and other fees such as cadastral appraisal fee, cadastral measurement fee.

Regarding land use levy:

According to Decree No. 45/2014/NĐ-CP of Vietnam’s Government, specific cases where land use levy must be paid include:

- Collection of land use levy upon land allocation by the State;

- Collection of land use levy upon change of land use purpose;

- Collection of land use levy upon recognition of land use rights (grant of certificates) for households and individuals for land used in a stable manner since before October 15, 1993, without any of the documents specified in Clause 1, Article 100 of the Land Law 2013 of Vietnam;

- Collection of land use levy upon recognition of land use rights (grant of certificates) for households and individuals for land used between October 15,1993, and before July 01, 2004, without the documents specified in Clause 1, Article 100 of the Land Law 2013 of Vietnam;

- Collection of land use levy upon recognition of land use rights (grant of certificates) for households and individuals for land allocated ultra vires or encroached or occupied between July 01, 2004, and before July 01, 2014, that are now considered by the State for grant of certificates

Depending on each case, the law stipulates different land use levy.

Regarding registration fee:

According to Clause 1 Article 2 of Decree No. 45/2011/NĐ-CP of Vietnam’s Government, housing and land are subjects of registration fee. Registration fee rate applied to housing and land is 0.5% (Clause 1 Article 7 of Decree No. 45/2011/NĐ-CP).

Regarding fees for issuance of Certificates of land use rights and assets attached to land include land use levy

According to Circular No. 02/2014/TT-BTC of the Ministry of Finance of Vietnam:

- For households and individuals in districts of central-affiliated cities; inner wards belonging to cities or towns directly under the province, the maximum fee is not more than VND 100,000/certificate for new issuance; maximum not more than VND 50,000/time for re-issuance (including re-issuance of certificate due to lack of confirmation space), replacement, or additional confirmation to the certificate.

In case the certificate is issued to households or individuals with only land use rights (no houses and assets attached to the land), a maximum fee of no more than VND 25,000/new certificate will apply; maximum not more than VND 20,000/time for re-issuance (including re-issuance of certificate due to lack of confirmation space), replacement, or additional confirmation to the certificate.

- For organizations, the maximum fee is no more than VND 500,000/certificate.

In case the certificate is issued to an organization with only land use rights (no houses or assets attached to the land), a maximum fee of no more than VND 100,000/certificate will apply.

In case of re-issuance (including re-issuance of a certificate due to lack of confirmation space), replacement, or additional confirmation to the certificate: The maximum fee shall not exceed VND 50,000/time.

The law also specifically stipulates which cases are exempt from land use fees, which cases are considered for land use fee reduction, and which cases do not have to pay registration fees.

Above are the main amounts that must be paid when applying for a Certificate of land use rights and assets attached to land. Depending on each specific case, the amounts payable increase or decrease differently.
