On September 11, 2024, the Government of Vietnam issued Decree 112/2024/ND-CP providing guidelines on rice cultivation land in Vietnam.

1. Newest plan for the crop and livestock structure shift occurring on rice cultivation land in Vietnam

According to the regulations in Article 7 of Decree 112/2024/ND-CP, the plan for the crop and livestock structure shift occurring on rice cultivation land in Vietnam is as follows:

- The Provincial People's Committee, based on the provincial land use planning and plan approved by competent authorities as prescribed by law, proposals from the District People's Committee, and recommendations from the provincial specialized agency for agriculture, shall issue the Plan for Transformation of Crop and Livestock Structure on rice cultivation land across the province according to the template in Appendix I issued with Decree 112/2024/ND-CP; the issuance date is before November 30 of the year preceding the planned year.

- The District People's Committee, based on the Plan for Transformation of Crop and Livestock Structure on rice cultivation land approved by the Provincial People's Committee, proposals from the Communal People's Committee, and recommendations from the district specialized agency for agriculture, shall issue the Plan for Transformation of Crop and Livestock Structure on rice cultivation land across the district according to the template in Appendix II issued with Decree 112/2024/ND-CP; the issuance date is before December 15 of the year preceding the planned year.

- The Communal People's Committee, based on the Transformation Plan approved by the District People's Committee and the conversion needs of rice cultivation land users, shall issue the transformation plan within the commune according to the template in Appendix III issued with Decree 112/2024/ND-CP; the issuance date is before December 30 of the year preceding the planned year.

2. Regulations on crop and livestock structure shift occurring on rice cultivation land in Vietnam

The  crop and livestock structure shift occurring on rice cultivation land in Vietnam is regulated in Article 6 of Decree 112/2024/ND-CP as follows:

- Principles for transforming crop and livestock structures on rice cultivation land

+ Must comply with the provisions in Clause 1, Article 56 of the 2018 Crop Production Law;

+ Only transform crop and livestock structures on rice cultivation land to perennial crops for the remaining rice cultivation land;

+ Do not convert crop and livestock structures on rice cultivation land in areas planned for high-yield, high-quality rice cultivation;

+ Must conform with the Plan for Transformation of Crop and Livestock Structure on rice cultivation land issued by the competent authority;

+ Must not cause pollution, degradation of rice cultivation land; must not damage transportation infrastructure, irrigation works, dike works, and facilities directly serving rice production;

+ Must not affect the cultivation of adjacent rice cultivation land.

- Transformation from rice cultivation to integrated rice cultivation with aquaculture permits the use of up to 20% of rice cultivation land area to lower the terrain for aquaculture with a depth not exceeding 120 centimeters compared to the field surface.

- The Chairman of the Provincial People's Committee decides on the types of perennial crops to be converted, ensuring they match the local practical conditions.

- The transformed rice cultivation land under the regulations in Decree 112/2024/ND-CP shall be accounted for as rice cultivation land.

More details can be found in Decree 112/2024/ND-CP which comes into force in Vietnam from September 11, 2024.
