This is a remarkable new content at Circular 25/2021/TT-BTC regulate on collection, collection, payment, management and use of fees and charges in the field of exit, entry, transit and residence in Vietnam, will take effect from May 22, 2021 in Vietnam.

03 cases are exempt from passport issuance fee from May 22 , 2021 in Vietnam (Illustration)
According to this Circular, Clause 2, Article 5 of Circular 25/2021/TT-BTC stipulates that 03 cases are exempted from passport issuance fees as follows:
- Overseas Vietnamese who have issued a decision on expulsion in writing by the competent authority of the host country but do not have a passport;
- Overseas Vietnamese must return home according to international treaties or agreements on the return of citizens who do not have passports;
- Circumstances for humanitarian reasons.
Currently, Circular 219/2016/TT-BTC (expired on May 22, 2021) does not provide for exemptions from passport issuance fees.
Thus, from May 22, 2021, in addition to the exemptions from visa issuance, Circular 25/2021/TT-BTC also adds 03 exemptions from passport issuance fees in Vietnam.
In addition, Circular 25/2021/TT-BTC also adds a case of visa exemption compared to Circular 219/2016/TT-BTC, namely:
Free of charge for the issuance of visas and temporary residence permits for foreigners in Vietnam who violate the law but are financially incapable and the representative mission of the country whose citizens are not funded or have no representative mission of the country whose citizens are violating the law in Vietnam (Currently, Circular 219/2016/TT-BTC does not contain this provision).
It should be noted thatthe determination of foreigners in Vietnam who violate the law is handled free of charge in this case by the fee collection organization considering the decision in each specific case and being responsible according to the provisions of law.
In addition, in the cases of exemption from fees and charges mentioned above, the organization collecting fees and charges must stamp "Free of Charge", "Free of Charge" (GRATIS) on the issued documents.
But since May 22, 2021, supplementing the police of districts, districts, towns and cities under provinces and centrally run cities; the police of communes, wards and townships (with the authority to issue entry and exit documents) is the organization that collects fees and charges (Article 3 of Circular 25/2021/TT-BTC).
Thus, from May 22, 2021, those who are exempt from the passport issuance fee under Clause 2, Article 5 of Circular 25/2021/TT-BTC will be exempt from the passport issuance fee.
In addition, Circular 25/2021/TT-BTC also supplements the exemption of visas and temporary residence for foreigners in Vietnam who violate the law and are sanctioned without financial capacity.
