What are penalty penalties for incestuous rape under the Criminal Code in Vietnam?

According to the provisions in Article 141 of the Criminal Code of Vietnam 2015 (amended in 2017) regarding the crime of rape as follows:

- Anyone who uses force, threatens to use force, exploits the victim's inability to defend themselves, or employs other means to have sexual intercourse or perform other sexual acts against the victim's will shall face imprisonment from 02 years to 07 years.

- Committing the crime in one of the following cases shall face imprisonment from 07 years to 15 years:

+ Organized manner;

+ Against a person whom the perpetrator has a duty to care for, educate, or treat;

+ Multiple offenders rape one victim;

+ Committing the crime two times or more

+ Against two or more persons;

+ Incestuous nature;

+ Causing the victim to become pregnant;

+ Inflicting injury, causing harm to health, or causing mental and behavioral disorders in the victim with a body injury rate from 31% to 60%;

+ Dangerous recidivism.

- The offender may also be prohibited from holding certain positions or practicing certain professions or performing certain jobs for 01 to 05 years.

Thus, committing rape with an incestuous nature shall be punished with imprisonment from 07 years to 15 years. Additionally, the offender may also be prohibited from holding certain positions or practicing certain professions or performing certain jobs for 01 to 05 years.
