05 Judgment applying precedence 08/2016/AL on determining and adjusting interest rates in credit contracts in Vietnam 12/07/2022

Precedence No. 08/2016/AL was approved by the Council of Judges of the Supreme People's Court and published under Decision No. 698/QD-CA of Vietnam dated October 17, 2016. Precedence has content to settle the issue of interest on the amount of late judgment execution. From the next day of the first-instance trial date, in addition to the principal amount, overdue loan interest, overdue loan interest and loan fee payable to the lender under the credit contract, the borrower must continue to bear the following obligations: overdue interest on the unpaid principal amount at the interest rate agreed upon by the parties in the contract or at the lending bank's interest rate.
