When will Vietnamese traffic police officers are authorized to stop vehicles? What are the requirements?

Pursuant to Circular 32/2023/TT-BCA, which regulates the tasks, powers, forms, content, and procedures for patrols, control, and handling of administrative violations in road traffic by the Traffic Police under the Ministry of Public Security, the following provisions apply:

Pursuant to Article 16 of Circular 32/2023/TT-BCA, traffic police officers are authorized to stop vehicles for control in the following four cases:

- Directly detecting or through technical devices detecting and collecting evidence of violations of road traffic laws and other legal violations.

- Carrying out orders and plans for overall vehicle control to ensure road traffic order and safety, social order; implementing plans for patrols, control, and handling of violations according to the authorized issued topics.

- Having written requests from the head or deputy head of the investigating agency; written requests from relevant functional agencies to stop vehicles for control in order to serve the work of ensuring security, order; fighting against crimes; preventing and combating natural disasters, fires, epidemics; rescue operations, and other legal violations.

- Receiving reports, feedback, suggestions, or denunciations from organizations or individuals regarding violations of the law by individuals or vehicles participating in road traffic.

Furthermore, according to Clause 2 of Article 16 of Circular 32/2023/TT-BCA, when stopping vehicles, the following requirements must be ensured:

- Safety, compliance with legal regulations, and not causing obstruction to traffic operations.

- When a vehicle has been stopped, the control and handling of violations (if any) must be carried out according to the regulations.

What are the requirements for stopping vehicles at Vietnam's Traffic Police Station?

Pursuant to the provisions of Article 16 of Circular 32/2023/TT-BCA, when stopping vehicles at the Traffic Police Station, the following requirements must be ensured:

- Safety, compliance with legal regulations, and not causing obstruction to traffic operations.

- When a vehicle has been stopped, the control and handling of violations (if any) must be carried out according to the regulations.

- Use barricades such as cone-shaped posts or stretched ropes along the road direction in the road section, lane close to the road shoulder, or sidewalk to create an area that ensures order and traffic safety.

- Based on the actual situation and characteristics of the traffic route, determine the appropriate length of the barricade section to ensure safety.

- The area ensuring order and traffic safety must comply with the provisions of the law, have sufficient space to arrange and install technical devices for control and handling of violations. Depending on the actual situation in the control area, specialized control topics may arrange traffic police officers to guide and regulate traffic, ensuring traffic safety.

What documents must drivers carry when operating vehicles in Vietnam?

Pursuant to Article 58 of the Law on Road Traffic 2008, it is stipulated as follows:

Conditions for drivers of vehicles to join in traffic
1. Drivers of vehicles to join in traffic must be of the age and in good health as prescribed in Article 60 of this Law, and proper driver licenses for the types of vehicle they are permitted to operate, which are granted by competent state agencies.
Learner drivers, when joining in traffic, shall practice driving on driving practice vehicles and have their driving supported by driving instructors.
2. When operating a vehicle, the driver shall carry the following papers:
a/ Vehicle registration paper;
b/ Driver license, for motor vehicle operators defined in Article 59 of this Law;
c/ Technical safety and environmental protection inspection certificate, for motor vehicles prescribed in Article 55 of this Law;
d/ Motor vehicle owner civil liability insurance certificate.

Thus, when operating a vehicle, the driver shall carry the following papers:

- Vehicle registration paper;

- Driver license, for motor vehicle operators defined in Article 59 of this Law;

- Technical safety and environmental protection inspection certificate, for motor vehicles prescribed in Article 55 of this Law;

- Motor vehicle owner civil liability insurance certificate.

However, according to the new regulations in Circular 32/2023/TT-BCA, if the mentioned documents are integrated into VNeID, from September 15, 2023, the vehicle operator can use the integrated information to replace the paper documents when requested by the traffic police.

Circular 32/2023/TT-BCA comes into force from September 15, 2023.
