Report on the 2024 Lunar New Year's Salary and Bonus Situation by December 25 to the Ministry of Labour, Invalids and Social Affairs of Vietnam

On the eve of the Lunar New Year 2024, the Ministry of Labour, Invalids and Social Affairs of Vietnam issued a document requesting the Departments of Labour, Invalids and Social Affairs in provinces and cities to report on the situation of wages, Tet bonuses, and labor relations in enterprises.

The relevant agencies are to compile and report data on the wage and wage debt situation for 2023; bonus plans based on business production results and labor relations within enterprises during the Gregorian New Year and Lunar New Year 2024; submit data to the Ministry of Labour, Invalids and Social Affairs of Vietnam by December 25.

To be specific, the Ministry of Labour, Invalids and Social Affairs of Vietnam requests directors of the Department of Labour, Invalids and Social Affairs to guide and support enterprises in their localities in coordinating with grassroots union organizations to review labor contracts, collective labor agreements, wage regulations, and bonus policies to implement wage, bonus policies and other policies for employees according to agreed terms and regulatory requirements.

Enterprises are to formulate bonus plans based on 2023 production and business results in accordance with labor laws and publicly announce them to employees within the enterprise.

The relevant agencies are to compile and report data on the wage situation and wage debt for 2023; bonus plans based on business production results and labor relations within enterprises during the Gregorian New Year and Lunar New Year 2024; submit data to the Ministry of Labour, Invalids and Social Affairs of Vietnam by December 25.

Lunar New Year 2024 Holiday schedule for employees in Vietnam

According to Clause 1, Article 112 of the Labour Code 2019, the regulations are as follows:

Holiday Leaves

1. employees shall have paid leave on the following holidays:

a) Gregorian New Year: 01 day (January 1 of the Gregorian calendar);

b) Lunar New Year: 05 days;

c) Victory Day: 01 day (April 30 of the Gregorian calendar);

d) International Labour Day: 01 day (May 1 of the Gregorian calendar);

dd) National Day: 02 days (September 2 of the Gregorian calendar and 01 adjacent day);

e) Hung Kings’ Commemoration Day: 01 day (March 10 of the lunar calendar).

On November 3, 2023, the Office of the Government of Vietnam issued Official Dispatch 8662/VPCP-KGVX in 2023 communicating the Prime Minister's opinion on Lunar New Year and National Day holidays in 2024.

The Prime Minister agreed with the proposal of the Ministry of Labour, Invalids and Social Affairs of Vietnam in Official Dispatch 4594/LD-TBXH-ATLĐ in 2023 that the Lunar New Year holiday will be from February 8, 2024, to February 14, 2024, and the National Day holiday will be from August 31, 2024, to September 3, 2024.

For employees in enterprises, the Ministry of Labour, Invalids, and Social Affairs indicates that based on actual conditions and the holiday schedules for officials and public employees, employers can arrange the Lunar New Year holiday for employees as follows (employers are encouraged to apply the Lunar New Year holiday schedule for employees as stipulated for officials and public employees).

- Lunar New Year 2024 Holiday:

+ Choose 01 day before Tet and 04 days after Tet or 02 days before Tet and 03 days after Tet or 03 days before Tet and 02 days after Tet.

+ Notify employees of the Lunar New Year holiday schedule at least 30 days before it takes effect.

Lunar New Year 2024 falls on a Saturday and Sunday, so the 2024 Lunar New Year holiday for employees will be as follows:

*For employees who do not work on Saturdays:

- If enterprises choose 01 day before Tet and 04 days after Tet:

employees will begin the Lunar New Year holiday from Friday, February 9, 2024 (30th day of the last lunar month of the Year of the Cat) to Thursday, February 15, 2024 (6th day of Tet).

- If enterprises choose 02 days before Tet and 03 days after Tet:

employees will begin the Lunar New Year holiday from Thursday, February 8, 2024 (28/12/2023 lunar calendar) to Wednesday, February 14, 2024 (5th day of Tet).

- If enterprises choose 03 days before Tet and 02 days after Tet:

employees will begin the Lunar New Year holiday from Wednesday, February 7, 2024 (27/12/2023 lunar calendar) to Tuesday, February 13, 2024 (4th day of Tet).

Thus, employees will have a continuous 7-day holiday, including 5 days of the state-prescribed Lunar New Year holiday and 2 compensatory days (due to overlapping with Saturday and Sunday, which are weekly rest days).

*For employees who work on Saturdays:

- If enterprises choose 01 day before Tet and 04 days after Tet:

employees will begin the Lunar New Year holiday from Friday, February 9, 2024 (30th day of the last lunar month of the Year of the Cat) to Wednesday, February 14, 2024 (5th day of Tet).

- If enterprises choose 02 days before Tet and 03 days after Tet:

employees will begin the Lunar New Year holiday from Thursday, February 8, 2024 (28/12/2023 lunar calendar) to Tuesday, February 13, 2024 (4th day of Tet).

- If enterprises choose 03 days before Tet and 02 days after Tet:

employees will begin the Lunar New Year holiday from Wednesday, February 7, 2024 (27/12/2023 lunar calendar) to Monday, February 12, 2024 (3rd day of Tet).

employees will have a continuous 6-day holiday, including 5 days of the state-prescribed Lunar New Year holiday and 1 compensatory day (overlapping with Sunday, which is a weekly rest day).

Note: The above holiday schedule is for reference only. The final decision on the Lunar New Year holiday schedule in 2024 will depend on each enterprise.

How many days off for employees on Gregorian New Year 2024 in Vietnam?

According to point a, Clause 1, Article 112 of the Labour Code 2019 on holiday leaves, employees will have one day off with full pay on the Gregorian New Year.

The holiday schedule for Gregorian New Year 2024 for employees is as follows:

*For employees with a fixed weekly rest schedule of two days on Saturday and Sunday:

employees will have three days off consecutively from Saturday, December 30, 2023, to Monday, January 1, 2024.

So, the total days off for Gregorian New Year 2024 will be 3 days (from December 30, 2023, to January 1, 2024).

*For employees with a one-day-per-week rest schedule (Sunday), they will have two days off for Gregorian New Year 2024 (from December 31, 2023, to January 1, 2024, i.e., Sunday and Monday).

If weekly rest day falls on another day, employees will observe Gregorian New Year on January 1, 2024. If it coincides with the regular rest day, the day off will be moved to the subsequent workday.
