Can Individuals with Tattoos Become State Officials?

According to the provisions of Articles 18, 19, and Article 20 of the Law on Cadres and Civil Servants 2008, regulations detailing what officials are prohibited from doing are as follows:

Prohibited actions related to official ethics

1. Evading responsibility, refusing to perform assigned duties; causing factions or internal disunity; abandoning work without permission or participating in strikes.

2. Using state or public property illegally.

3. Exploiting or abusing duties and powers; using information related to official duties for personal gain.

4. Discriminating on the basis of ethnicity, gender, social class, beliefs, or religion in any form.

Prohibited actions related to state secrets

1. Officials are prohibited from disclosing information related to state secrets in any form.

2. Officials working in sectors related to state secrets are not permitted, for at least five years from the date of retirement or resignation, to work in jobs related to their previous positions for domestic or foreign organizations, individuals, or joint ventures with foreign entities.

3. The Government of Vietnam prescribes specific sectors, jobs, and time limits for which officials cannot work and policies applicable to those subject to the provisions of this Article.

Other prohibited actions

In addition to the prohibitions outlined in Articles 18 and 19 of this Law, officials are also prohibited from engaging in activities related to production, business, personnel work as specified in the Anti-Corruption Law, the Law on Thrift Practice and Waste Prevention, and other actions as prescribed by law and relevant authorities.

Based on these regulations, there is no stipulation that having tattoos is prohibited for officials. Therefore, having tattoos does not affect one's eligibility to become an official.

How to Become a State Official?

According to the provisions of Clause 1, Article 1 of the amended Law on Cadres, Civil Servants, and Public Employees 2019, the regulation on civil servants is as follows:

Amendments and supplements to certain provisions of the Law on Cadres and Civil Servants

1. Amend and supplement Clause 2 of Article 4 as follows:

A civil servant is a Vietnamese citizen recruited and appointed to a grade, position, or title corresponding to the job position in agencies of the Communist Party of Vietnam, the State, or socio-political organizations at the central, provincial, and district levels; in agencies, units of the People's Army that are not officers, professional soldiers, or defense employees; in agencies, units of the People's Police that are not officers, non-commissioned officers serving under professional policies, or police employees, who are part of the state's payroll and receive salaries from the state budget.

To become a state official, Vietnamese citizens must undergo one of two forms of recruitment: examination or selection, as prescribed in Clause 5, Article 1 of the amended Law on Cadres, Civil Servants, and Public Employees 2019:

Civil servant recruitment methods

1. Civil servant recruitment is conducted through examination or selection, except as specified in Clause 3 of this Article.

The form, content of the exam, and selection of civil servants must meet the requirements of the job position in each sector, ensuring the choice of individuals with suitable qualities, qualifications, and abilities.

Eligibility conditions for civil servant recruitment are stipulated in Article 4 of Decree 138/2020/ND-CP of 2020 as follows:

Conditions for civil servant recruitment registration

Recruitment conditions for civil servants are implemented according to Clause 1 of Article 36 of the Law on Cadres and Civil Servants. The employing agency determines additional conditions based on job position requirements as per Point g, Clause 1, Article 36 of the Law on Cadres and Civil Servants, conforming to the competency framework for the job position but not lower than general standards, and not contrary to legal provisions. These conditions are reported in writing to the civil servant management agency for consideration and decision.

To register for civil servant recruitment, individuals must meet the following conditions: Have Vietnamese nationality; be at least 18 years old; submit an application; have a clear personal background; possess appropriate diplomas and certificates; have good political and ethical qualities; have sufficient health to perform duties; and meet other requirements specific to the job position.

Civil servant examination methods:

According to Article 8 of Decree 138/2020/ND-CP of 2020, the civil servant examination comprises two rounds:

- Round 1: General knowledge and competency assessment

The content of this round includes three parts:

Part I: General knowledge – 60 questions assessing understanding of the political system, organizational structures of the Communist Party, the State, and socio-political organizations; state administrative management; officials, civil service, and other knowledge to evaluate competency. Exam duration: 60 minutes;

Part II: Foreign language – 30 questions according to job position requirements in one of five languages (English, Russian, French, German, Chinese) or another language as decided by the head of the competent authority recruiting civil servants. Exam duration: 30 minutes. (Exemption from this test is possible for candidates with foreign language degrees as per Point c, Clause 1, Article 8 of Decree 138/2020/ND-CP of 2020);

Part III: Informatics – 30 questions according to job position requirements. Exam duration: 30 minutes. (Exemption from this test is possible for candidates with degrees in informatics or information technology as per Point d, Clause 1, Article 8 of Decree 138/2020/ND-CP of 2020);

- Round 2: Specialized professional knowledge examination

The content includes an assessment of knowledge on the Party's policies, laws on the recruitment sector, and evaluation of the candidate's public service performance skills according to job position requirements.

Selection methods:

According to Article 10 of Decree 138/2020/ND-CP of 2020, the civil servant selection is as follows:

Candidates for civil servant selection:

1. Civil servant recruitment through selection as decided by the competent recruitment authority is implemented separately for the following groups:

a) Those voluntarily committing to work for at least five years in economically and socially disadvantaged areas;

b) Those nominated to study under policies per the Education Law, returning to work in the location that nominated them;

c) Outstanding graduates, young talented scientists.

2. Recruitment of individuals under Point c, Clause 1 of this Article is implemented as per Government policies on attracting and creating sources of cadres from outstanding graduates and young scientific personnel.

The selection methods for civil servant recruitment per Article 11 of Decree 138/2020/ND-CP of 2020 comprise two rounds:

- Round 1

Check the recruitment registration conditions listed on the registration form per job requirements. If conditions are met, candidates proceed to Round 2.

- Round 2 (scored on a 100-point scale).

Interview assessing knowledge, skills for public service performance per job position requirements;

Interview duration: 30 minutes (candidates have up to 15 minutes for preparation before the interview);

What Score is Required to Pass the Civil Servant Exam or Selection?

The results for passing the civil servant examination are stipulated in Article 9 of Decree 138/2020/ND-CP of 2020 as follows:

Determining the pass criteria in the civil servant examination

1. Successful candidates in the civil servant examination must meet the following conditions:

a) Achieve a score of at least 50 points in the second round. If the examination includes both interviews and written tests, candidates must participate in both;

b) Achieve a score in the second round combined with priority points per Article 5 of Decree 138/2020/ND-CP of 2020, higher in descending order within the recruitment quota for each job position.

2. In cases where two or more candidates have the same total score per Point b Clause 1, the candidate with a higher second-round score will be selected; if still indistinguishable, the head of the recruitment authority decides.

3. Unsuccessful candidates in the civil servant examination are not entitled to retain results for future exams.

Therefore, successful candidates in the civil servant examination must participate in both interviews and written tests, achieving at least 50 points.
