On November 10, 2023, the National Assembly passed Resolution 104/2023/QH15 regarding the state budget estimate for 2024.

According to this, concerning the implementation of salary policies, the National Assembly resolves that starting from July 1, 2024, comprehensive reforms of salary policies will be implemented in accordance with Resolution 27-NQ/TW in 2018 of the 7th plenum of the 12th Central Committee. This includes adjusting pensions, social insurance allowances, monthly allowances, preferential allowances for those with meritorious services, and some social security policies that are linked to the basic salary.

Speaking at a meeting on the first working day after the Lunar New Year holiday, held on the morning of February 15, Minister of Labor, Invalids, and Social Affairs Dao Ngoc Dung stated that in 2024, comprehensive reforms of salary policies will be carried out according to Resolution 27-NQ/TW in 2018. Salary reform must go hand in hand with adjusting pension policies in the spirit of "not allowing retirees to face more difficulties and disadvantages during the reform".

During salary reform, if the general wage level of the country's workforce increases but pensions are not well adjusted, pension recipients will be greatly disadvantaged.

Therefore, it is necessary to calculate and balance accordingly. If the salary of officials and public employees increases by 23.5%, then at least pensions should increase by 15%.

However, there will be no pension increase for 36 units in certain sectors that no longer enjoy special salary policies. If the payroll is constructed horizontally, some agencies may experience a 50% reduction in salaries.

According to the spirit of Resolution 27-NQ/TW in 2018, agencies with special payrolls will be preserved (no additional increase) to ensure fairness for pension recipients.

Therefore, starting from July 1, 2024, when implementing the salary reform, the majority of officials and public employees who currently receive salaries from the state budget in general, and specifically officials of People's Court, may receive a 15% increase in pensions, except for officials and public employees belonging to the 36 units applying special financial and income mechanisms, who may not receive a pension increase.

What are 02 official payrolls applicable to officials after the salary reform in Vietnam in 2024?

Pursuant to Resolution 27-NQ/TW in 2018, the unified 02 official payrolls will be implemented as follows during the salary reform in 2024:

Payroll 1:

This payroll applies to officials and public employees holding leadership positions (elected and appointed) in the political system from central to commune level, based on the following principles:

+ The salary level must reflect the hierarchy in the political system. Those holding leadership positions will receive salaries according to their positions. If a person holds multiple positions, they will receive the highest salary level of those positions. If the leadership positions are equivalent, they will receive the same salary level. The salary level of higher-level leaders must be higher than that of lower-level leaders.

+ There will be a designated salary level for each type of equivalent position. There will be no classification based on ministries, sectors, departments, committees, and equivalents at the central level when constructing the central payroll for positions. There will be no differentiation in salary levels for the same leadership position based on the classification of local administrative units, which will be implemented through an allowance system.

+ The classification of equivalent leadership positions within the political system for designing the position payroll will be decided by the Politburo after reporting to the Central Executive Committee.

Payroll 2:

This payroll applies to officials and public employees who do not hold leadership positions and is based on officials' ranks and public employees' professional titles. Each officials' rank and public employees' professional title will have multiple salary levels based on the following principles:

+ For the same level of job complexity, the salary level will be the same. Higher labor conditions and professional benefits will be implemented through a professional allowance system. The grouping of ranks and the number of salary levels within officials' ranks and public employees' professional titles will be rearranged, encouraging officials and public employees to enhance their professional knowledge and skills.

+ Appointment to officials' ranks or public employees' professional titles must be linked to job positions and the structure of officials' ranks and public employees' professional titles will be implemented by the agencies, organizations, and units responsible for managing officials and public employees.

Vietnam: What are the cases where employees may retire at a younger age according to current regulations?

Pursuant to the provisions of Article 5 of Decree 135/2020/ND-CP, an employee, in any of the following circumstances, may retire at the age earlier but not exceeding 5 years before the statutory retirement age, determined until the retirement date, unless otherwise prescribed by law:

- He/she has at least 15 years’ doing laborious, toxic and dangerous occupations or highly laborious, toxic and dangerous occupations on the lists of the Minister of Labor, War Invalids and Social Affairs.

- He/she has at least 15 years’ working in highly disadvantaged areas, including the period he/she works in areas with the region-based allowance of at least 0.7 (allowance for those working in disadvantaged areas) before January 01, 2021 on the list of the Minister of Labor, War Invalids and Social Affairs.

- His/her work capacity reduction is at least 61%.

- He/she has at least total 15 years’ doing the occupations specified in point a and working in the areas specified in point b, Clause 1 of Article 5 of Decree 135/2020/ND-CP

The time of retirement is determined according to Clause 2, Article 5 and Appendix II issued with Decree 135/2020/ND-CP.
