Will the Government of Vietnam issue the Law on exit and entry in the near future?

This content is stated in Resolution No. 46/NQ-CP in 2023 as follows:

Regarding the proposal to develop a Law amending and supplementing a number of articles of the Law on exit and entry of Vietnamese citizens and the Law on entry, exit, transit and residence of foreigners in Vietnam:

- The Government of Vietnam agreed on the necessity and objectives of amending and supplementing the Law on Exit and Entry of Vietnamese citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam in order to:

+ Institutionalizing the Party's guidelines, overcoming obstacles and inadequacies in the implementation of these two laws;

+ Create a legal basis to promote administrative reform, decentralize the settlement of administrative procedures, and carry out administrative procedures in the electronic environment;

+ Create favorable conditions for the people, contributing to the socio-economic development of the country.

- The Government of Vietnam basically agreed with the policy of developing 01 law amending and supplementing the above 02 laws to report to the National Assembly for approval at the 6th session (October 2023) according to the process of 01 session.

At the same time, the Ministry of Public Security was assigned to assume the prime responsibility for, and coordinate with the Ministry of Justice and relevant agencies in, continuing to study and absorb the opinions of members of the Government of Vietnam on 04 policies; complete the dossier of request for law formulation in accordance with the provisions of the Law on Promulgation of Legislative Documents; submitted to the Government of Vietnam at the Regular Government of Vietnam Meeting in March (expected to be April 3, 2023).

The Government of Vietnam increases the duration of e-visas to a maximum of 3 months?

The Government of Vietnam has agreed to increase the duration of e-visas as the content in Section 5 of Resolution No. 46/NQ-CP in 2023 at the thematic session on law-making in March 2023.

According to that, on the draft Resolution on a number of new policies in the field of management of entry, exit, transit and residence of foreigners in Vietnam:

The Government of Vietnam assigned the Ministry of Public Security to assume the prime responsibility for, and coordinate with the Ministry of Justice in, completing legal procedures for the Government of Vietnam to submit to the National Assembly for consideration and inclusion in the National Assembly's Joint Resolution at its 5th Session (May 2023) a number of new policies in the field of management of entry, exit, transit and residence of foreigners in Vietnam about 03 policies as follows:

(1) Implement the policy of granting electronic visas to citizens of all countries and territories. Assign the Government of Vietnam to decide on a specific list of countries and territories on the basis of reciprocity, ensuring national defense, security, social order and safety, and economic and social development of Vietnam;

(2) Increase the duration of e-visa from no more than 30 days to no more than 03 months, valid once or multiple times;

(3) Increase the time limit for granting temporary residence certificates at the border gate for people entering unilateral visa exemption from 15 days to 45 days.

At the same time, assign the Minister of Public Security to sign the Government of Vietnam's report to submit to the National Assembly at the 5th Session on the above content.

Agree to change the name of the Law on Citizen Identification?

In Section 1 of Resolution No. 46/NQ-CP in 2023, this content is noted as follows:

Inheriting relevant regulations, overcoming shortcomings, inadequacies and limitations of the 2014 Law on Citizen Identification; request to continue simplifying administrative procedures and citizenship papers to meet the requirements of current and future practice; and at the same time create favorable conditions for the exercise of citizens' rights and obligations in transactions in service of life, economic and social development, contributing to promoting national digital transformation, building a digital Government, digital society.

The Ministry of Public Security shall assume the prime responsibility for, and coordinate with relevant ministries and agencies in, expeditiously completing the dossier of the Law project as follows:

- Regarding the name of the Law: Unified to rename the Law on Citizen Identification to the Law on Identity.

- Regarding the collection, update, connection, sharing, exploitation and use of information in the Identity Database (Article 17 of the draft Law): Agree to assign the Government of Vietnam to detail this content.

- Regarding the issuance of citizen identity cards to people under 14 years old (Article 20 of the draft Law); on information integration (Article 23 of the draft Law); on transitional provisions (Article 46 of the draft Law); ... it is necessary to continue to assess the impact, review and study carefully, ensure feasibility, avoid causing conflicts with relevant laws.

To prescribe in the law the contents with high stability and uniformity; new and volatile contents shall be assigned to the Government of Vietnam to provide regulations to ensure flexibility in administration and timely adjustment to suit reality. Continue to review relevant international treaties to have regulations suitable to Vietnam's characteristics and conditions and the development of technology on the principle of creating maximum convenience for people when using identity cards in transactions; to ensure privacy and personal secrets according to the provisions of the Constitution.

The Ministry of Public Security shall assume the prime responsibility for, and coordinate with the Ministry of Justice, the Government Office and relevant agencies in, studying and absorbing opinions from members of the Government of Vietnam, appraisal opinions of the Ministry of Justice, and opinions of the Government Office, completing the dossier of the Law project as prescribed. Assign the Minister of Public Security, under the Prime Minister's authorization, on behalf of the Government of Vietnam to sign and submit to the National Assembly and the National Assembly Standing Committee the draft Law on Identity.
