Who must apply for issuing and replacing ID cards from July 1, 2024? Are Vietnamese citizens required to apply for replacement of ID cards under the newest regulations?
Under Article 19 of the Law on Identification 2023, ID cards shall be issued to:
- Persons eligible for issuance of ID cards are Vietnamese citizens.
- Vietnamese citizens from 14 years of age shall carry out procedures for the issuance of ID cards.
- Vietnamese citizens under 14 years of age will be issued with ID cards if they have demands.
In addition, Article 21 of the Law on Identification 2023 stipulates the age eligible for replacement of ID cards as follows:
Age eligible for replacement of ID cards
1. A Vietnamese citizen issued with an ID card shall carry out procedures for replacement of the card when he/she reaches from 14 years of age, 25 years of age, 40 years of age and 60 years of age.
2. An ID card which is issued, replaced or re-issued within 2 years before a citizen reaches the age specified in Clause 1 of this Article shall remain valid until he/she reaches the subsequent age eligible for card replacement.
Thus, cases of replacement of ID cards include: A Vietnamese citizen issued with an ID card shall carry out procedures for replacement of the card when he/she reaches from 14 years of age, 25 years of age, 40 years of age and 60 years of age.
In addition, Clause 1, Article 46 of the Law on Identification 2023 specifies:
Transitional provisions
1. Citizen ID cards issued before the effective date hereof shall be valid until the expiry date specified in such cards, except for the case specified in Clause 3 of this Article. The citizen ID cards will be replaced by ID cards at the request of citizens.
Under the above regulations, the cases of issuance and replacement of ID cards include: A Vietnamese citizen who is 14 years of age has never been issued an ID card or citizen ID card; A Vietnamese citizen already has a citizen ID card but its validity period has expired.
Vietnamese citizens under 14 years of age, a citizen, and Vietnamese citizens holding valid citizen ID cards will be issued with ID cards if they have demands.
A Vietnamese citizen shall carry out procedures for the replacement of his/her ID card when he/she reaches from 14 years of age, 25 years of age, 40 years of age and 60 years of age
Citizen ID cards issued before July 1, 2024 have the same validity as an ID card and are valid until the expiry date specified in such cards. Therefore, in cases where citizens are using citizen ID cards that are still valid, they will continue to be used until the expiry date before having to change to identification cards, except in cases where citizens wish to replace citizen ID cards with ID cards.
From July 1, 2024, what are the procedures for issuance of an ID card to a Vietnamese citizen from 14 years of age?
Under the provisions of Clause 1, Article 23 of the Law on Identification 2023, the procedures for issuance of an ID card to a Vietnamese citizen from 14 years of age from July 1, 2024 are specified as follows:
Step 1: A recipient shall inspect and compare the information of a person to be issued with an ID card from/to the national population database, the national database, and the specialized database in order to ensure the accuracy of information of such person;
In case information of a person to be issued with an ID card on the national population database is unavailable, procedures for adjustment and update of information on the national population database shall be carried out according to regulations in Clauses 1,2 and 3 Article 10 of Law on Identification 2023.
Step 2: The recipient shall collect information about identity and biometric identifiers, including portrait photo, fingerprints and iris of each person to be issued with an ID card;
Step 3: Each person to be issued with an ID card shall conduct inspection and signature on an ID information collection form;
Step 4: The recipient shall issue a receipt stating the date of handover of the identity card to the citizen;
Step 5: The ID card shall be handed to the citizen at the place stated in the receipt; in case a citizen wishes to receive his/ her card at another place, the identification-managing agency shall hand the card to him/her at the place as requested by the citizen and he/she shall pay fees for delivery services.
Notes: Legal representatives of incapacitated persons and persons with limited recognition and behavioral control shall be appointed to assist such persons to follow the above procedures.
In case of refusal to issue ID cards, the identification-managing agency shall provide an explanation in writing and clearly state the reasons.
What are the places for receiving the applications for issuance, replacement, and re-issuance of citizen identity cards in Vietnam?
Under the provisions of Article 10 of Circular 59/2021/TT-BCA as follows:
Receipt of application for issuance, replacement, re-issuance of Citizen Identity Card
1. Citizens shall apply at competent police authorities where the citizens register for temporary, permanent residence in person for issuance, replacement, re-issuance of Citizen Identity Cards.
2. In case citizens apply for issuance, replacement, re-issuance of Citizen Identity Cards online on National public service portal or public service portal of Ministry of Public Security, citizens shall select service, examine and verify their information in National database on population, in case of accurate information, register time and location for issuance of Citizen Identity Cards; the system shall then transfer applications to police authorities where the citizens wish to apply to.
In case of inaccurate information, citizens shall present legal documents at competent police authorities capable of receiving application for issuance, replacement, re-issuance of Citizen Identity Cards as proof.
In addition, Article 26 of the 2014 Law on Citizen Identification stipulates:
Places for carrying out procedures for issuance, replacement and re-issuance of citizen identity cards
Citizens may choose any of the following places for carrying out procedures for issuance, replacement or re-issuance of citizen identity cards:
1. The citizen identification management agency of the Ministry of Public Security;
2. Citizen identification management agencies of Public Security Departments of provinces and centrally run cities;
3. Citizen identification management agencies of Public Security Divisions of rural districts, urban districts, towns and provincial cities or equivalent administrative units;
4. When necessary, competent citizen identification management agencies shall carry out procedures for the issuance of citizen identity cards at communes, wards, townships, agencies, units or citizens’ places of residence.
Thus, Vietnamese citizens may apply for issuance, replacement, and re-issuance of citizen identity cards in Vietnam at:

The Law on Identification 2023 will come into force from July 1, 2024, except for the cases specified in Clause 3, Article 46 of the Identity Law 2023, which will come into force from January 15, 2024.
