Who is the Head of the National Anti-Terrorism Steering Committee?

Article 3 of Decree 07/2014/ND-CP stipulates regarding the National Anti-Terrorism Steering Committee:

National Anti-Terrorism Steering Committee

1. The National Anti-Terrorism Steering Committee is an advisory body that assists the Government of Vietnam and the Prime Minister in organizing, directing anti-terrorism work nationwide.

The Ministry of Public Security is the permanent body of the National Anti-Terrorism Steering Committee and has a specialized advisory and assisting agency called the Standing Office of the National Anti-Terrorism Steering Committee.

2. The composition of the National Anti-Terrorism Steering Committee includes:

- The Prime Minister of Vietnam, Head of the Committee;

- The Minister of Public Security, Deputy Head of the Committee;

- The Minister, Head of the Government Office, Member;

- The Minister of Foreign Affairs, Member;

- The Minister of Transport, Member;

- The Minister of Information and Communications, Member;

- The Minister of Health, Member;

- The Minister of Finance, Member;

- The Governor of the State Bank of Vietnam, Member;

- The Deputy Minister of Public Security in charge of security work, Standing Member;

- The Chief of the General Staff of the People’s Army of Vietnam, Deputy Minister of Defense, Member.

3. In necessary cases, the Government of Vietnam will decide to supplement additional members who are ministers or other high-ranking officials to participate in the National Anti-Terrorism Steering Committee based on the proposal of the Head of the Committee.

Thus, according to the above regulation, the Prime Minister is the head of the National Anti-Terrorism Steering Committee.

Article 6 of Decree 07/2014/ND-CP outlines the duties and powers of the National Anti-Terrorism Steering Committee as follows:

- Perform duties and powers as stipulated in Clause 1, Article 13 of the Anti-Terrorism Law 2013.

- Inspect, urge, and guide the Anti-Terrorism Steering Committees of ministries, sectors, provinces, and centrally-run cities to implement anti-terrorism work.

- Submit to the Prime Minister plans for handling terrorism situations and mechanisms for directing and commanding the handling of terrorism situations.

- Advise the Government of Vietnam and the Prime Minister on directing the resolution of terrorism cases in situations where it is necessary to declare a state of emergency on national security, order, and social safety, or when there is a threat to national security, order, and social safety that has not yet reached the level of declaring a state of emergency.

- Perform other duties and powers assigned by the Government of Vietnam and the Prime Minister.

What is the operating regime of the Anti-Terrorism Steering Committee?

Article 11 of Decree 07/2014/ND-CP stipulates the operating policies of the Anti-Terrorism Steering Committee as follows:

Operating Regime of the Anti-Terrorism Steering Committee

1. The Anti-Terrorism Steering Committee operates on the principle of centralized unity; decisions on issues within its authority are made through regular, extraordinary meetings, or by collecting written opinions. The Head of the Steering Committee concludes and is responsible for his decisions. The Anti-Terrorism Steering Committee is responsible for issuing and implementing its operating regulations.

2. Assign the Minister of Public Security to establish, define the functions, duties, and organizational structure of the Standing Office of the National Anti-Terrorism Steering Committee and the Standing Offices of the Anti-Terrorism Steering Committees of provinces and centrally-run cities; the Minister or the head of an agency at the ministerial level defines the functions, duties, and organization of the agency or unit assisting the Anti-Terrorism Steering Committees of their ministries or sectors.

Clause 4 of Article 1 Decree 62/2023/ND-CP supplements regulations on the operating policies of the Anti-Terrorism Steering Committee:

4. Clause 1a after Clause 1 of Article 11 is supplemented as follows:

“1a. Members of the Anti-Terrorism Steering Committees at all levels work on a concurrent basis, perform duties and powers according to the operating regulations of the Steering Committee, and use the seal of the agency where they work. In cases where the Head of the Steering Committee is absent or delegates authority, the Deputy Head performs the duties and powers of the Head and is legally responsible for his decisions.”

From October 5, 2023, the Anti-Terrorism Steering Committee will have additional operating policies as follows:

- Members of the Anti-Terrorism Steering Committees at all levels work on a concurrent basis, perform duties and powers according to the operating regulations of the Steering Committee, and use the seal of the agency where they work. In cases where the Head of the Steering Committee is absent or delegates authority, the Deputy Head performs the duties and powers of the Head and is legally responsible for his decisions.
