The authority to decide on extending the service duration for non-commissioned officers and conscripts of the People’s Public Security Force is based on Clause 1, Article 8 of the Law on People's Public Security 2018 as follows:

Obligation to Participate in the People's Public Security Force

1. Citizens who perform the obligation to participate in the People's Public Security Force fulfill their national defense obligation in the armed forces. Annually, the People's Public Security Force selects citizens of conscription age to serve in the People's Public Security for a duration of 24 months. The Minister of Public Security decides on extending the service duration for non-commissioned officers and conscripts of the People’s Public Security Force but not exceeding 06 months in the following cases:

a) To ensure readiness for combat missions;

b) While performing natural disaster, epidemic prevention, and rescue missions.

2. The procedures for selecting citizens to perform the obligation to participate in the People's Public Security Force are applied similarly to the selection of citizens for military service.

3. The Government of Vietnam regulates in detail Clause 2 of this Article.

Article 24 of the Law on People's Public Security 2018 stipulates as follows:

Positions, Titles of Officers in the People's Public Security Force

1. The basic positions of officers in the People's Public Security Force include:

a) Minister of Public Security;

b) Head of Department, Commander;

c) Director of Provincial/Municipal Police Departments;

d) Head of Division; Chief of District-level Police, town, city under province, city under centrally governed city; Regiment Commander;

dd) Team Leader; Chief of Communal-level Police; Battalion Commander;

e) Company Commander;

g) Platoon Leader;

h) Squad Leader.

2. Equivalent positions to the ones specified at points b, c, d, đ, e, g, and h, Clause 1 of this Article, and other positions and titles in the People's Public Security Force are defined by the Minister of Public Security.

3. Professional titles and standards for professional titles of officers in the People's Public Security Force are stipulated by the Minister of Public Security following legal regulations.

What are the duties and powers of the People's Public Security Force of Vietnam?

Based on Article 16 of the Law on People's Public Security 2018, it is stipulated as follows:

Duties and Powers of the People's Public Security Force

1. Collect information, analyze, evaluate, predict the situation and propose to the Communist Party and the State to enact and implement policies, laws, and strategies for national security protection, social order, and safety assurance, crime prevention and combating, and violations of national security, social order, and safety laws; participate in appraising and assessing the impact on national security, social order, and safety concerning socio-economic development planning, plans, projects in accordance with legal regulations; closely combine national security protection, social order and safety assurance, crime prevention and combating, and violations of national security, social order, and safety laws with socio-economic development tasks; effectively coordinate security activities with national defense and foreign affairs activities.

2. Proactively prevent, detect, stop, and combat to thwart schemes and activities infringing national security, eliminate threats to national security; protect the independence, sovereignty, unity, and territorial integrity of the Fatherland; protect the Communist Party, the State, the People, and the socialist policies; protect political security, security in the spheres of ideology - culture, economy, national defense, foreign affairs, information, society, environment, science, and technology; protect other interests of the nation; protect the great unity bloc of the entire nation; protect the lives, health, honor, dignity, property, freedom, democracy of citizens, and the lawful rights and interests of institutions, organizations, individuals.

3. Conduct intelligence activities following the law.

Protect senior leaders of the Communist Party, the State, international guests visiting and working in Vietnam; protect events and important political, economic, diplomatic, scientific - technical, cultural, social targets; protect important projects related to national security, foreign representative bodies, representatives of international organizations in Vietnam; protect individuals holding or closely related to national secrets; protect the transportation of special goods per the law.

5. Implement management concerning national security protection, state secret protection; assume the primary role in managing the entry, exit, transit, residence of foreigners in Vietnam; manage the exit, entry of Vietnamese citizens following legal regulations; control entry, exit, and transit at border gates following the law; cooperate with the People's Army, relevant sectors, and local authorities in managing, protecting the national border, border gates, islands, seas, airspace, and perform tasks of national security protection, social order, and safety assurance in border areas following the law, international treaties that the Socialist Republic of Vietnam is a member of, and relevant international agreements.

6. Conduct management concerning cybersecurity, network security protection, and cybercrime prevention following the law.

7. Conduct management concerning investigation and crime prevention work. Assume the primary role in anti-terrorism, anti-riot tasks, and resolving complex national security, social order, and safety situations following the law. Proactively prevent, detect, stop, and combat crimes and violations concerning social order, safety, environmental protection, resources, and food safety related to the environment; receive and resolve crime reports, denunciations, and recommendations for prosecution; prosecute, investigate crimes following the law; perform criminal statistics work; discover the causes, conditions of crime emergence and violations concerning social order, safety, environmental protection, and recommend remedies; educate law violators in the community under the law.

8. Conduct management concerning criminal judgment enforcement, detention, temporary detention enforcement; manage prisons, temporary detention centers, custody houses, compulsory education facilities, correctional institutions; organize the enforcement of sentences, judicial decisions, and judicial measures; supervise and educate juvenile offenders exempted from criminal liability; manage individuals granted parole with conditions; perform escort, transport, warehouse management of exhibits, court security, and perform other judicial support tasks following the law.

9. Conduct management concerning administrative violations in national security, social order, and safety; impose administrative penalties and perform administrative measures according to legal regulations; ensure security and order during enforcement of coercive decisions upon request by competent authorities.

10. Conduct management concerning residence, national population database, citizen identity card database, seals, traffic safety, public security, weapons, explosives, explosive precursors, support tools, fire prevention, firefighting, rescue, and relief following the law; issue and manage national ID cards and other personal documents; register, issue, and manage license plates for road motor vehicles; perform fire prevention, firefighting, rescue, and relief tasks; and conduct management concerning security and order for conditional business sectors according to the law.

11. Assume the primary role, cooperate with and perform propaganda work, educate on national security protection, social order, and safety assurance, crime prevention and combating, and violations concerning national security, social order, and safety; guide, inspect, audit, resolve complaints, denunciations, and handle violations in national security protection activities, social order, and safety assurance, crime prevention and combating, and violations concerning national security, social order, and safety.

12. Lead the construction of the people's security posture and the people's security force, building the movement of all people protecting the national security. Guide organizations and institutions to perform security protection tasks concerning internal political security, economic security, ideological-cultural security, network security, information security, social security, environmental security.

13. Guide, train professional skills, and provide legal knowledge training for mass organizations participating in security and order protection at grassroots, neighborhood watch, community defense units, corporate security following the law.

14. Apply measures to mobilize the masses, law, diplomacy, economics, science and technology, professional, and armed forces to protect national security, ensure social order and safety, combat crime, and violations related to national security, social order, and safety.

15. Use weapons, explosives, support tools, force, professional technical means, and other means to attack and capture criminals, stop individuals engaged in criminal acts or other illegal acts, and for legitimate self-defense per the law.

16. Decide or recommend the suspension or temporary suspension of activities of institutions, organizations, or individuals posing a threat or potentially posing a threat to national security, social order, and safety; request institutions, organizations, or individuals to provide information, documents, or objects when there is a solid basis to determine their involvement in activities infringing on national security, social order, and safety following the law. Mobilize, requisition per the law information means, transportation means, and other means and individuals using or controlling those means in urgent cases to protect national security, ensure social order and safety, or prevent social harm consequences happening or at risk of happening.

17. Implement measures to protect national security, ensure social order and safety following the law during wartime, emergency situations, or when there is a threat to national security, social order, and safety that does not yet require a state of emergency.

18. Manage and develop security industry; research, apply, mobilize scientific and technological achievements for national security protection, social order and safety assurance, combat crime, and violations related to national security, social order and safety, and build the People's Public Security Force.

19. Build a revolutionary, regular, elite, gradually modernized People's Public Security Force, prioritizing the modernization of certain forces; act as the core in performing national security protection tasks, ensuring social order and safety, combating crime, and violations related to national security, social order and safety.

20. Perform international obligations; cooperate internationally in combating crime, protecting national security, ensuring social order and safety, and building the People's Public Security Force; perform mutual judicial assistance in criminal matters following the law. The Ministry of Public Security is the central authority of the Socialist Republic of Vietnam in extradition activities and transferring persons serving prison sentences.

21. Perform other tasks and powers according to legal provisions.

Thus, the People's Public Security Force has duties and powers according to the above regulations.
